Methods of conducting space tourism activities in the light of international law – how to remedy potential conflict of laws?

This paper analyses the concept of space tourism in terms of methods required to conduct such activities within the scope of international law. It highlights challenges that emerge for the international space law, especially regarding the suborbital flights. It’s not clear from the point of view of international law which legal regime might be applicable to such endeavor. Unlike any other space flights, suborbital flights consists both of elements from international aviation law and international space law. This paper discuss hypothetical solutions to potential conflicts of law that may arise in connection to such activities. It also aims to provide clarity to ambiguities regarding international law in this area.

Legal aspects of airport slot allocation: a challenge for the European Union

With the increase in the number of operations performed at airports in European Union countries, airport slots' allocation problemis becoming more apparent. Legal regulations in this areawere adopted over two decades ago, which means that they are not suitable for commercial aviation's contemporary reality, which has undergone a considerable change during the indicated period. This article aims to analyse the current legal framework for allocating slots at the level of international law, with particular emphasis on the European Union law. The main reasons affecting the urgent need to amend the provisions in the presented scope will be discussed. These issues include, for example, the problem of slot trading between air carriers. The impact of the EU response to the COVID-19 epidemic on the air carrier's situation concerning slots will be outlined. Selected examples illustrating difficulties in applying EU rules will also be analysed in detail. The summary will be followed by an indication of crucial de lege ferenda postulates in the discussed area.

Wraz ze wzrostem liczby wykonywanych operacji w portach lotniczych państw Unii Europejskiej coraz wyraźniej rysuje się problem przydziału czasów na start i lądowanie (dalej slot). Regulacje prawne w tym zakresie powstały ponad dwie dekady temu, co sprawia, że nie są one dostosowane do współczesnych realiów lotnictwa komercyjnego, które przez wskazany okres przeszło ogromną przemianę. Przedmiotowy artykuł ma na celu analizę obecnie obowiązujących ram prawnych dotyczących przydziału slotów, na poziomie prawa międzynarodowego, ze szczególnym uwzględnieniem prawa Unii Europejskiej. Przedstawione zostaną główne czynniki wpływające na konieczność nowelizacji przepisów w omawianym zakresie oraz kwestie, które nie zostały expressis verbis uregulowane, zaś istnieje rynkowa potrzeba nadania im instytucjonalnego charakteru. Do zagadnień takich należy chociażby problematyka obrotu slotami pomiędzy przewoźnikami lotniczymi. Analizie poddane zostaną także rozwiązania dotyczące analizowanej kwestii przyjęte przez UE w związku z epidemią COVID-19. Podsumowanie poprzedzone zostanie wskazaniem kluczowych postulatów de lege ferenda w omawianym zakresie.
