Artykuł poświęcony jest zagadnieniu umyślności w kontekście czynu zabronionego z art. 178a kodeksu karnego – prowadzenia pojazdu w stanie nietrzeźwości lub pod wpływem środka odurzającego. Wskazano na trudności w ustalaniu umyślności ze względu na brak narzędzi badawczych pozwalających wejrzeć w psychikę sprawcy, przy jednoczesnej konieczności uświadamiania sobie znamienia nietrzeźwości jako kluczowego elementu realizacji aktu woli. Omówiono wybrane orzecznictwo Sądu Najwyższego w tym zakresie.

Article is devoted to the issue of intent in the context of an offense of art. 178a of the Criminal Code - driving under the influence of alcohol or an intoxicant. It points out to the difficulty in determining the intent due to the lack of research tools that would allow insight into the psyche of the perpetrator, while at the need to be aware of the fact of being intoxicated as a key element of the implementation of an act of will. Discussed are some of the adjudications of the Supreme Court in this regard.

We propose a system whereby subtle semantic ambiguity found in queries of distributed heterogeneous database systems can be resolved by considering the user's intentions. Through the use of domain-specific knowledge embedded within a mediator-based architecture, subtleties in meaning can be explicitly modeled. Through the use of dynamic profiles and active dialogue, the system can discover user intent, providing more satisfying query answers.
