Artykuł zawiera analizy i refleksje związane z obecnym kształtem modelu bezpieczeństwa indywidualnego konsumentów na rynku energii. Autorzy, przedstawiając szereg doktrynalnych definicji związanych z bezpieczeństwem, finalnie prezentują syntetyczną propozycję rozumienia bezpieczeństwa indywidualnego konsumentów w sektorze energetycznym, uwzględniającą najnowsze trendy krajowej oraz europejskiej legislacji. W artykule przedstawiono także omówienie zjawiska ubóstwa energetycznego, katalogu definicji odbiorców z ustawy (Prawo energetyczne) mechanizmów wsparcia odbiorcy wrażliwego w postaci dodatku energetycznego oraz ryczałtu na opał, a także nowej instytucji ADR (ang. Alternative Dispute Resolution) w energetyce – polubownego rozwiązywania sporów – Koordynatora do spraw negocjacji. Na podstawie przedstawionych analiz autorzy zauważają m.in., że na przestrzeni lat 2013–2017 wyklarowała się tendencja rozwijania nowych uprawnień konsumenckich (instrumentów ochronnych) w energetyce.

The article „Modern polish model of individual consumer security in the energy market – selected definitional and system aspects” includes analyses and reflections related to the current shape of the individual consumer security model in the energy market. The authors, by making an analysis of a number of security-related definitions, present their own proposal for the definition of individual consumer security in the energy sector, taking the latest trends in national and European legislation into account. The article also contains an overview of the phenomenon of energy poverty, a catalog of definitions of recipients from the Energy Law, sensitive customer support mechanisms in the form of an energy allowance and fuel payment as well as a new ADR institution in the energy industry – alternative dispute resolution – negotiation Coordinator. Based on the presented analyses the Authors notice, inter alia, that in the years 2013–2017 a trend towards the development of new consumer rights (protective instruments) in the energy sector emerged.

Przedmiotowy artykuł omawia kwestie związane z wprowadzeniem do polskiego systemu prawnego nowej instytucji ADR – Koordynatora do spraw negocjacji. W tym względzie przeanalizowane zostały wcześniejsze rozwiązania prawne. Przedstawione zostało także bezpośrednio tło zmian, tryb powołania, kompetencje oraz ograniczenia związane z pełnieniem funkcji Koordynatora. Autor stawia tezę, iż gwarancje bezpieczeństwa indywidualnego (dostaw) występować będą na etapie prowadzenia postępowania przez Koordynatora do spraw negocjacji (ale tylko dla odbiorców paliw gazowych, energii elektrycznej lub ciepła w gospodarstwie domowym), natomiast nie będą się one wiązać z rezultatem tego postepowania. W tym sensie można mówić jedynie o „wspieraniu lub przyczynianiu się Koordynatora do spraw negocjacji do wzrostu (poczucia) bezpieczeństwa indywidualnego konsumentów na rynku energii”, lecz już nie o jego gwarantowaniu sensu stricte.

This article discusses issues related to the implementation a new ADR institution – the Negotiations Coordinator in the Polish legal system. In this regards, previous legal solutions have been analyzed. Also, the background of changes, the appointment procedure, the competences, limitations in the exercise of the Coordinator function, have been presented. The author claims that guarantees of personal consumer safety (only in respect of household customers of gas, electricity and heat) are present at the stage of commencing and conducting proceedings by the Negotiation Coordinator (supplies guarantees), but are not the result of this procedure. In this case, it was possible to talk only about “supporting or contributing by the Negotiations Coordinator to the growth of personal consumer safety in the energy market”, but not to the guaranteeing of personal consumer safety in the strict meaning.
