Autorka na podstawie wybranych przedsiębiorstw, znajdujących się w rozporządzeniu Rady Ministrów z 2015 r., dokonuje analizy ich zadań na rzecz przygotowań obronnych państwa. Przedstawia obowiązki przedsiębiorcy z tytułu obowiązku wykonywania zadań na rzecz bezpieczeństwa państwa i dokumenty jakie powinien wykonać. Wykazuje, że zasoby powinny być na bieżąco monitorowane i sprawdzane, ponieważ często teoria jest tylko teorią, a praktyka pokazuje zupełnie inne oblicze. Lista przedsiębiorstw w nowelizowanym co kilka lat rozporządzeniu mogłaby być dłuższa, lecz zdolności finansowe państwa do finansowania np. z Programu Mobilizacji Gospodarki utrzymania tych rezerw są ograniczone.

The present article concerns contractors with particular importance for economical and defense area in Poland. Author focused on systematisation of concepts regarding country defense preparation and defining what role does the contractors with particular importance for economical and defense area, fulfill in the defense preparation system of the country. The ponderings are written based on company examples such as: LOTOS, PKP INTERCITY, POLPHARMA.The project is based on authors research analysis who gain an insight into that topic. Analysis of legal documents regulating country defense issues and authors conclusion.

Artykuł przedstawia przekrojową informację nt. obowiązujących wymagań przepisów prawnych związanych z funkcjonowaniem przedsiębiorców w warunkach wyższych stanów gotowości obronnej państwa. W artykule omówiono działalność Stałej Komisji Technicznej związaną z zakresem odpowiedzialności w temacie nadzoru nad opracowywaną dokumentacją oraz prawidłowym funkcjonowaniem przedsiębiorcy w ramach wykonywania nałożonych zadań obronnych. Omówiono potrzebę i obowiązek przeprowadzania szkoleń obronnych z pracownikami w zakresie wprowadzania wyższych stanów obronności państwa. Przedstawiono sposób funkcjonowania stałego dyżuru w jednostkach zmilitaryzowanych oraz zaprezentowano zakres dokumentacji, jaka powinna być prowadzona w ramach stałego dyżuru. Zwrócono uwagę na wymogi współpracy z Rejonowym Przedstawicielstwem Wojskowym w temacie weryfikacji opracowanych kart realizacji zadań obronnych, zawierających określoną pracochłonność wykonania poszczególnych nałożonych zadań obronnych. W podsumowaniu zwrócono uwagę na obowiązki przedsiębiorcy związane z przygotowaniem kompletu dokumentacji oraz wymagań technicznych w zakresie utrzymywania mocy produkcyjnych i remontowych, w sytuacji gdy nałożono na niego zadania obronne.

An overview of information about binding legal regulations on functionality of businesses in conditions of higher levels of state defence alert is presented in the paper. The paper dwells on the activities of the Permanent Technical Committee linked with the scope of responsibilities concerning the supervision of the documentation which has to be prepared and proper functioning of a business owner performing the received defensive tasks. The need and obligation for carrying out defence training courses on introduction of higher levels of state defence is discussed. The functioning of a permanent duty service in the militarised units and the scope of documentation to be processed at the duty is described. An attention was paid to demands of cooperation with the Military Regional Representation on the verification of prepared cards for the performance of defence tasks including specifications of time schedules for particular imposed defensive tasks. Finally the obligations of business owners connected with preparation of complete documentation and technical specifications for maintaining the production and renovation capacities were noted in case if defence tasks were imposed.

Celem niniejszego artykułu jest pokazanie istoty dwóch zasadniczych elementów, jakże ważnych w procesie przeciwdziałania zagrożeniom bezpieczeństwa państwa: podstawowych aktów prawnych odnoszących się do funkcjonowania państwa w warunkach zewnętrznego zagrożenia bezpieczeństwa państwa i w stanie wojny oraz zawartych w nich zadań w zakresie powszechnego obowiązku obrony, a także koncepcji przygotowania urzędu administracji rządowej, do realizacji tych zadań. Do realizacji zadań w ramach powszechnego obowiązku obrony zobowiązani są nie tylko ministrowie i kierownicy urzędów centralnych, ale także organy władzy rządowej oraz samorządowej na wszystkich szczeblach podziału administracyjnego państwa. Jednocześnie wychodząc z założenia obowiązku zapewnienia przez państwo zintegrowanego bezpieczeństwa narodowego, bez podziału na wewnętrzne i zewnętrzne bezpieczeństwo, wskazano i omówiono mechanizm systemu stałych dyżurów wykorzystywany w procesie podnoszenia gotowości obronnej państwa, który włączony został do postanowień ustawy o zarządzaniu kryzysowym z 2007 r. Wskazano dokumenty strategiczne oraz dokumenty opracowywane w ramach planowania obronnego w państwie, a także omówiono wariant koncepcji realizacji zadań obronnych.

The aim of the article is to present the essence of two extremely important elements while counteracting the state security threats. The first element considers the basic legal acts related to state functioning both in case of external threat for the state security and in case of war. The second element considers the basic legal acts relating to the tasks of national defense service and the concept of preparing the governmental administration to carry out those tasks. Despite the ministers and the heads of central state offices, also the bodies of governmental and self – governmental authorities on all levels of state administration structure are responsible for completion of the tasks of national defense service. At the same time, assuming the state obligation for integrated national safety, and without the division into external and internal security, the paper presents and discusses the mechanism of permanent duties increasing the state defense readiness. The system was included in the decision of Law from 2007 about the crisis management . Some strategic documents and the documents prepared for the state defense planning have been presented. The concept of the defense tasks completion has been discussed.

Maintaining all forces that participate in ensuring and keeping the defensive readiness of the country on the highest level is very expensive, hence the readiness procedures specify the strategic (including operational) development. In strategic development all state entities tasked with defensive duties gain defensive readiness. The aim of the strategic development is to achieve the defensive readiness of the country. This process is mostly activated by the emergence of the threat of war. The most important task connected with fighting off the aggression is executed by the Armed Forces, which achieve their readiness through procedures of operational development. Depending on a threat, only selected forces can achieve readiness. When faced with the threat of the high intensity conflict, the whole Armed Forces achieve their readiness. The process of the Armed Forces achieving readiness and the country gaining defensive readiness can be an instrument of strategic deterrence and should be designed for de-escalation of threats, not their escalation.

Research results presented in J.Glasgall and A. Połowniak’s doctoral dissertation entitled “Perspective Communication System Model to Direct State Defence in Emergency Situations” concerning threats for telecommunication knots contributed the author to write this article. Basing on general threats that may appear in some areas of Poland under research, possible threats that may affect telecommunication knots functioning have been described. Selected research results have been presented in the article to popularise these results and apply them in practice.

The article consists of two parts. The first one presents the idea of armed forces in peacetime and factors conditioning their preparation to mobilisation deployment in case of war. The author starts his considerations on the armed forces mobilisation system from the definition of a system and its components. A special attention has been paid to principles of the armed forces mobilisation system: the principle of centralised mobilisation activity; keeping the state of mobilisation readiness of the armed forces; the principle of a cyclic reserve soldiers training; territorial collection of human resources; the principle of confidentiality of mobilisation preparations in the armed forces. The idea of the system and legal bases of its functioning in peacetime have been discussed.
