Within the meaning of the Geological and Mining Act, geological operation is the performance, as part of geological activity, of any actions below the surface, including the use of blasting agents, as well as the liquidation of excavations after these operations. Depending on the details, especially concerning the purpose and method of carrying out these operations, they require a license or approval of their project. However, a geological operation project sometimes requires only a notification to the competent geological authority, without the need of its approval. There are also such geological operations that are not subject to the requirements of the Geological and Mining Act at all (e.g. some shallow well drillings). The results of geological activities, along with their interpretation, are subject to presentation in the geological report. In principle, it requires approval by the competent geological authority. The condition for such a decision is the compliance of the geological report with the law.

Wskazane zostały wybrane kluczowe zagadnienia odpowiedzialności wykonawców prac rozpoznawczych zarówno za ich wyniki końcowe jaki i częściowe oraz za ich wykorzystanie w dalszej działalności. Zaprezentowano niektóre ogólne problemy geoetyki, które powinny być brane pod uwagę przez decydentów odpowiedzialnych za podejmowanie prac rozpoznawczych.

Several key moments in the whole process have been selected to show the expected responsibility of “players” who should guarantee the reliability of partial and final exploration results for the following exploitation process. Furthermore some general problems of geoethics are presented which have to be taken into consideration by decision makers responsible for exploration and exploitation processes.

Sporządzanie dokumentacji geologicznych, jest podstawową formą przekazywania informacji o wynikach badań geologicznych, które są wykorzystywane w praktyce. Na zagadnienia etyczne jej sporządzana i odpowiedzialność wykonawcy często zwraca się niedostateczną uwagę. Geolog jest twórcą informacji wykorzystywanych w praktyce. Możliwość sprawdzania ich poprawności jest ograniczona i korzystanie z dokumentacji jest oparte na zaufaniu jej wykonawcy, że przedstawione w niej dane są rzetelne a ich interpretacja poprawna. Zawód geologa wymaga zatem zaufania publicznego i poczucia odpowiedzialności za przedstawiane wyniki prac geologicznych. Wszelkie wątpliwości odnośnie przedstawianych informacji geologicznych, powinny być rzetelnie przedstawiane ich użytkownikowi. Ograniczoność wiedzy geologicznej, możliwość popełniania błędów w interpretacji danych powoduje konieczność oceny opracowań dokumentacyjnych przez niezależnych kompetentnych opiniodawców („koreferentów”).

Geological report is the basic tool of presentation of results of geological field work. It is used in various practical applications. The ethical problems of their presentation and geologist responsibility of it are seldom discussed. The possibility of immediate verification of geological data and interpretation is limited and utilization of geological reports is based on confidence as to its correctness. Geologist should be always aware of professional responsibility. All doubts on data and interpretations should be presented to the customer of report, to avoid erroneous or harmful its understanding and utilization. Because the possibility of not correct interpretations of geological data exist, due to the imperfectness of geological knowledge, the opinion of independent person is always indispensable.
