Grunt zajęty pod wodę płynącą należy do właściciela wód, którym w Polsce jest Skarb Państwa. Celem artykułu była analiza przepisów ustawy Prawo wodne dotyczących ustalenia linii brzegu, jako granicy nieruchomości należącej do właściciela wód, w odniesieniu do zasad pomiaru granic nieruchomości uregulowanych przepisami prawa geodezyjnego. Ze względu na dynamiczny charakter linii brzegu, problemy z jej identyfikacją oraz błędy na mapach ewidencyjnych, zaproponowano odpowiedni schemat działania w celu prawidłowego wykazania stanu prawnego nieruchomości. Omówiono również wpływ, jaki ma tak ustalona granica na nieruchomości należących do właścicieli gruntów przyległych.

Land occupied by flowing water belongs to the owner of the waters, which in Poland is the State Treasury. The aim of the article was to analyze the provisions of the Water Law Act concerning the delimitation of the coastline, as the boundary of the property belonging to the owner of the waters, in relation to the principles of property boundary measurement regulated by geodetic law. Due to the dynamic nature of the coastline, problems with its identification, and errors on cadastral maps, an appropriate action scheme was proposed to correctly demonstrate the legal status of the property. The impact of such established boundaries on properties belonging to the owners of adjacent lands was also discussed.
