Amendment to the Act on special rules of preparation and implementation of investment in public roads resulted in an accelerated mode of acquisition of land for the development of roads. The decision to authorize the execution of road investment issued on its basis has several effects, i.e. determines the location of a road, approves surveying division, approves construction design and also results in acquisition of a real property by virtue of law by the State Treasury or local government unit, among others. The conducted study revealed that over 3 years, in this mode, the city of Krakow has acquired 31 hectares of land intended for the implementation of road investments. Compensation is determined in separate proceedings based on an appraisal study estimating property value, often at a distant time after the loss of land by the owner. One reason for the lengthy compensation proceedings is challenging the proposed amount of compensation, unregulated legal status of the property as well as imprecise legislation. It is important to properly develop geodetic and legal documentation which accompanies the application for issuance of the decision and is also used in compensation proceedings.

Zmiana ustawy o szczególnych zasadach przygotowywania i realizacji inwestycji w zakresie dróg publicznych spowodowała przyspieszony tryb pozyskiwania gruntów przeznaczonych pod budowę dróg. Wydawana na jej podstawie decyzja o zezwoleniu na realizację inwestycji drogowej wywołuje szereg skutków, tj. m.in. ustala lokalizację drogi, zatwierdza podziały geodezyjne, zatwierdza projekt budowlany a także powoduje nabycie nieruchomości z mocy prawa, przez Skarb Państwa lub jednostki samorządu terytorialnego. Przeprowadzone badania wykazały iż w powyższym trybie miasto Kraków nabyło w okresie 3 lat ponad 31 ha gruntów przeznaczonych na realizację inwestycji drogowych. Odszkodowanie ustalane jest w drodze odrębnego postępowania w oparciu o operat szacunkowy określający wartość nieruchomości, niejednokrotnie w odległym terminie od chwili utraty gruntów przez właściciela. Jedną z przyczyn przedłużających się postępowań odszkodowawczych jest kwestionowanie proponowanej kwoty odszkodowań, nieuregulowane stany prawne nieruchomości a także nieprecyzyjne przepisy prawne. Istotne znaczenie ma prawidłowe opracowywanie dokumentacji geodezyjno-prawnej dołączanej do wniosku o wydanie decyzji a także wykorzystywanej w postępowaniach odszkodowawczych.

W artykule przedstawiono przebieg postępowania oraz zawartość dokumentacji geodezyjno-prawnej, sporządzanej na potrzeby regulacji stanów prawnych istniejących dróg publicznych. Omówione regulacje wynikają z ustawy Przepisy wprowadzające ustawy reformujące administrację publiczną z 1998 r Dokumentacja sporządzana na potrzeby przejścia z mocy prawa na rzecz Skarbu Państwa lub jednostek samorządu terytorialnego gruntów, które w dniu 31 grudnia 1998 r. pozostawały we władaniu właściwych instytucji pod drogami publicznymi jest niezbędna do wydania decyzji deklaratoryjnej wojewody. Na tle obowiązującej ustawy, wytycznych technicznych oraz analizowanych postępowań dotyczących regulacji stanów prawnych nieruchomości dokonano oceny istniejących rozwiązań. Regulacja stanów prawnych istniejących dróg powinna zostać pobudzona pilnymi działaniami o charakterze prawnym i technicznym. Brakuje jednoznacznych przepisów określających przebieg postępowania i skład dokumentacji. Eliminację subiektywnej interpretacji przepisów oraz ograniczenie do minimum zakresu dokumentacji niezbędnej do osiągnięcia celu pracy mogłyby zapewnić elektroniczne systemy komunikacji między urzędami, sądami. geodetami i innymi zainteresowanymi.

This article presents course of procedure and contents of geodesic-legal documentation created for the purpose of legal status regulations of existing public roads. Introduced regulations result from the Rules for implementing the law reforming public administration from 1998. Documentation is created to legal status regulation of lands in abeyance which on day 1998-12-31 was occupied under the public roads and is indispensable to carry out a voivode decision. On the basis of the Act, technical instruction and studies about practical procedures - estimation of existing solutions is presented. For active legal status regulations- legal and technical operations are indispensable. Unequivocal rules about course pf procedure and contents of geodesic-legal documentation are needed. For eliminated subjective rules interpretation and limited to minimum contents of geodesic-legal documentation - electronic systems of communication between offices, courts, surveyors and others interested are advisable.

Geodesy in the collective perception is understood as an activity consisiting in studying the Earth's shape, geodetic networks establishing, mapping, border marking and real estate recording. The know ledge about input and possibilities of geodesy in building investments' realization process, as well as in construction of large machines and installations, is relatively modest even among interested building specialists. These structures are usually closely connected with geographical space and they have an important influence on social and biological environment of the region (e.g. hydroelectric power station - provides both employment and power, at the same time being a serious danger in case of natural calamity or damage of control system) - so information about them is connected in many aspects with geoinformation and with space information systems as far as technology of realization of geodetic and cartographic studies and exploitation of geodesic tools (like methodology,measurement technology, instrument technology are concerned. The goal of the project, being realized by the Institute of Engeneering and Industrial Geodesy of Warsaw University of Technology, is to create a prototype database of building structures, which are typical from the point of view of the tasks of engineering geodesy. These are structures as follows: architectural (i.e. buildings, shopping centers, renovation and reconstruction of historical objects) transport (i.e. roads, overpasses, train infrastructure, tunnels, bridges, airports) hydrotechnical (i.e. dams, hydroelectric power stations) machines and installations (i.e. turbines, gantries, rotary furnaces, ships, airplanes). Creation of a database is going to be preceded by studies on preparing uniform methodology of presenting consecutive stages of geodetic works for various objects as described above. The database is expected to be available by internet and is planed to be filled with the information collected from geodesic companies, which would like to present their realizations as well as from owners and users of engineering structures. Examples of modern solutions in the area of geodetic services for engineering investments realization is supposed to create a base for changes in the methods of teaching and presenting these issues in The Geodesy and Cartography Department of Warsaw University of Technology and in other Departments interested in such problems.

W pracy przedstawiono strukturę organizacji czynności dotyczących realizacji autostrad oraz podstawy prawne, związane z ustaleniem lokalizacji, przygotowaniem dokumentacji geodezyjnej i formalno-prawnej niezbędnej dla celów nabycia gruntu na rzecz Skarbu Państwa, oraz uzyskanie decyzji o pozwoleniu na budowę.

The author in paper gives many legal acts including laws and ordinances, concerning the acquisition of real estate required for the motorway building, concession for the construction, operation and location of the motorways. The law binding from 10 April 2003r concerning special rules of preparation and implementation (Dz. U. No 80, item 721 of2003) aims at acceleration of investments by shortening some periods of waiting for particular documents and necessary decisions. Besides, it transfers the proceeding related to preparation of a motorway construction to preparation o f a motorway construction to a Voivodeship Office. Aforementioned law makes possible earlier preparation of investment and consequently utilization of EU funds includes grants.
