W artykule opisano istotne zmiany prawne w branży geodezyjnej i w szkolnictwie wyższym, które wystąpiły w ostatnim 5-leciu. Geodezja została zdefiniowana przez prof. Zdzisława Adamczewskiego jako wielki system informacyjny państwa. Dla poprawy działania tego systemu Władysław Baka w ostatnich publikacjach zaproponował wykorzystanie prakseologicznych zasad sprawnego działania, sugerując branżową nazwę „Prakseologia geodezyjna”. W szkolnictwie wyższym wraz z wprowadzeniem w 2011 r. Krajowych Ram Kwalifikacji określono wymagane efekty kształcenia. Na kierunku geodezja i kartografia, szczególnie w małych uczelniach, nie wszystkie wymagane efekty kształcenia są możliwe do uzyskania. Dlatego też autor artykułu dla poprawy tego stanu proponuje wprowadzenie nowego przedmiotu nauczania pod nazwą „Prakseologia geodezyjna” jako przedmiotu obligatoryjnego i tym samym popiera propozycję Władysława Baki. W artykule zamieszczono autorską propozycję tematyczną tego przedmiotu.

The article presents important changes in legal regulations referring to both geodesic branch and to the higher education in Poland within the last 5 years. Prof. Zdzisław Adamczewski defined geodesy as an enormous informational system of the state. To improve this system’s functioning Władysław Baka in his latest publications proposed employing of praxeological principles of efficient functioning under the branch name of “geodesic praxeology”. With the introduction of Polish Qualifications Framework in the higher education in 2011 required teaching outcomes were determined. In geodesy and cartography departments, especially in smaller universities, obtaining all of these required teaching outcomes may be problematic. As a remedy, in support of Władysław Baka’s suggestion, the article’s author proposes introduction of a new obligatory teaching subject under the name of “geodesic praxeology”. The article contains also the author’s thematic suggestions for this subject.

Real estate cadastre versus land and buildings register in Poland, with the view to concepts’ identification

Currently in Poland, the problems associated with changes in the functioning of the institutions of the cadastre are becoming very topical. These include the problem of cadastre’s location within the structures of the State, the definition of its role and significance in the context of the functions and tasks that it should perform. When introducing the legal concept of real estate cadastre into circulation, the legislator stipulated that until the transformation of the existing land and buildings register is completed, the term cadastre is to signify precisely these land and buildings register. Therefore, a problem arises, concerning the consequences of the parallel use, and the interchangeability of the two terms: ‘land and buildings register’, and ‘cadastre’, each of which have their historical, legal and technical references and implications. In this publication, we carry out an analysis of historical and current conditions for the functioning of the land and buildings register, and the real estate cadastre, in terms of the current legislation.

Obecnie w Polsce aktualna staje się problematyka związana ze zmianami funkcjonowania instytucji katastru. Problem jego usytuowania w strukturze państwa, jego zdefiniowania, określenia roli i znaczenia w kontekście funkcji i zadań, jakie powinien pełnić. Ustawodawca wprowadzając do obiegu prawnego pojęcie katastru nieruchomości zastrzegł, że do czasu przekształcenia istniejącej ewidencji gruntów i budynków pod pojęciem kataster rozumiana ma być właśnie ewidencja gruntów i budynków. W związku z tym pojawia się problem dotyczący konsekwencji wynikających z posługiwania się równolegle i zamiennie terminami ewidencja gruntów i budynków oraz kataster nieruchomości, które to terminy mają swoje odniesienia historyczne, prawne i techniczne. W prezentowanej publikacji dokonana została analiza historycznych i aktualnych uwarunkowań funkcjonowania ewidencji gruntów i budynków oraz katastru nieruchomości w ujęciu aktualnie obowiązujących przepisów prawnych.
