During the performance of building work contracts it often happens that the investor refuses to pay remuneration for works completed by the contractor. One of the most frequent reasons of such non-payment is the investor's claim that works are defective or were not performed in accordance with good building practices. In such case, the investor usually does not question the fact of conclusion of the contract, performance of building works or its obligation to pay remuneration to the contractor, but refrains from such payment, referring to the fact that building works were performed in a faulty manner, which means that the provisions of the contract were violated.
