Decarbonisation - origins and evolution of the process on the European level

Decarbonisation of the European economy is one of the most important megatrends that will shape economic and social development in the coming years. This paper discusses the basic concepts of decarbonisation in terms of climate change, the history of this idea development and the legal basis introduced in the European Union, including key European documents and tools influencing the process, like ETS or CO2 emission allowances. Background on decarbonisation has been presented as a European roadmap to achieve a low-carbon economy in Europe. In the article the main assumptions of the EU strategy papers like Clean Energy for All Europeans or the European Green Deal are presented. Casus Silesia indicates the basic problematic issues that coal regions will have to tackle to due to the transition away from coal. For European societies, the new environmental policy of the European Commission means the intensification of activities to reduce greenhouse gas emissions and switching the economy to low- or zero-carbon energy sources and technologies. The decarbonisation of the economy is an ongoing process which has been gaining momentum in recent years. The coal transition is a huge challenge, particularly for Poland.

Modern power engineering meets new challenges. With the development of new energy production and storage technologies, creates new demands for energy services. To support this development, it is necessary to implement new teleinformatic systems that will allow for resource management. Such systems are called Virtual Power Plants (VPP). There are many definitions of this type of solutions due to the very wide range of possible applications. VPPs can be developed by many types of entities, e.g. distribution system operators, electricity generators, energy clusters. The ability to build a system based on modules allows you to customize the system to user’s needs. An opportunity for the development of VPP will bea package “Clean energy for all Europeans” (so called “Winter package”) that introduces regulations that allow for the development of renewable energy sources, including prosumers, and enables an active participation in the energy market for energy consumers. In addition, more stringent requirements for balancing production and energy consumption are introduced, requiring greater balancing accuracy.

Współczesna energetyka stoi przed nowymi wyzwaniami. Wraz z rozwojem nowych technologii wytwarzania i magazynowania energii tworzy się zapotrzebowanie na nowe usługi energetyczne. By wesprzeć ten rozwój konieczne jest wdrażanie nowych systemów teleinformatycznych, które pozwolą na zarządzanie tymi zasobami. Systemy takie nazywane są Wirtualnymi Elektrowniami (ang. Virtual Power Plant - VPP). Istnieje wiele definicji tego typu rozwiązań ze względu na szerokie możliwości ich zastosowania. Wirtualne Elektrownie mogą być wdrażane przez wiele rodzajów podmiotów np. operatorów systemów dystrybucyjnych, wytwórców energii elektrycznej lub klastry energetyczne. Tworzenie systemu opartego o budowę modułową pozwala na dostosowanie systemu do potrzeb użytkownika. Szansą na rozwój VPP będzie zbiór dokumentów „Czysta energia dla wszystkich Europejczyków” (zwany również „Pakietem zimowym”), który wprowadza regulacje wspierające rozwój odnawialnych źródeł energii, w tym prosumentów, oraz umożliwia aktywny udział w rynku energii dla konsumentów energii. Dodatkowo, bardziej rygorystyczne wymagania w zakresie bilansowania produkcji i zużycia energii wymagają wyższej jakości tego procesu.

Opracowanie prezentuje zagadnienia procesowe unormowane w art. 47946 - 47956 Kodeksu postępowania cywilnego. Jego celem jest przedstawienie i analiza kluczowych kwestii pojawiających się w trakcie postępowania sądowego wszczętego wskutek wniesienia odwołania od decyzji Prezesa URE. Dowodzi, iż do postępowania cywilnego skierowano sprawy, które w innych systemach prawnych są poza tym postępowaniem i których natura prawna wcale nie wymaga przekazania do postępowania cywilnego, co potwierdzają przytoczone wypowiedzi wiodących przedstawicieli nauki.

Presented are lawsuit problems regulated by art. 47946 - 47956 of the civil procedure code. The aim of this elaboration is presentation and analysis of some key problems arising during legal proceedings commenced in consequence of appealing against a decision of the President of Energy Regulatory Office. There is proved that for civil proceedings were brought cases which in other legal systems are not subject to that kind of proceeding and whose legal nature does not require passing them on to the civil proceeding, what is also confirmed by the quoted opinions of some leading science representatives.
