W publikacji dokonano wykładni przepisu art. 93 ust. 3 ustawy o gospodarce nieruchomościami warunkującego możliwość dokonania podziału nieruchomości od zapewnienia wydzielanym działkom gruntu dostępu do drogi publicznej. W rezultacie przeprowadzonej wykładni językowej, z uwzględnieniem wniosków wynikających z systemowego i funkcjonalnego rozumienia tej regulacji, sformułowano tezę, iż pojęcie „dostępu do drogi publicznej” na potrzeby jej stosowania powinno być interpretowane w ujęciu funkcjonalnym, a nie formalnym i określonym przedmiotowo zakresie odniesionym jedynie do wydzielanych w wyniku podziału nieruchomości działek gruntu.

The publication interprets the provision of Art. 93 sec. 3 of the Real Estate Management Act, which determines the possibility of dividing real estate from providing access to a public road for the separated plots of land. As a result of the linguistic interpretation, taking into account the conclusions resulting from the systemic and functional understanding of this regulation, the thesis was formulated that the concept of "access to a public road" for the purposes of its application should be interpreted in a functional, not formal and subject-related scope, related only to the resulting division of real estate plots of land.

Artykuł dotyczy dróg wewnętrznych oraz uwarunkowań prawnych z nimi związanych. Zwrócono uwagę na potrzebę doprecyzowania przepisów prawnych, przede wszystkim dotyczących egzekucji obowiązujących przepisów. Przedstawiono przykład jednej z dróg wewnętrznych, gdzie kierowcy nieprawidłowo zaparkowanych samochodów naruszają obowiązujące normy prawne. Podkreślono potrzebę regulacji przepisów prawnych w szczególności w zakresie ich egzekucji przez odpowiednie organy i służby.

The work relates to issues of internal roads and the legal conditions associated with them. It took note of the need to clarify the legislation in this area, in particular as regards the enforcement of laws. This was done on the basis of one example of the internal roads, where drivers improperly parked cars violate applicable legal standards. Considerable attention was paid mainly to the applicable laws and enforcement capacity. It highlighted the need for regulation laws, in particular with regard to their execution by the relevant authorities and services.

Artykuł dotyczy problemu ujawniania się uszkodzeń i deformacji utwardzonych placów, dróg wewnętrznych i obejść budynków, spowodowanych wpływami robót górniczych na powierzchnię. W pracy omówiono stosowane dawniej oraz obecnie metody utwardzania dużych placów. Podany został przykład zabudowy, w obrębie której utwardzone zostały znacznych rozmiarów powierzchnie. W wyniku prowadzonej w przeszłości i obecnie eksploatacji górniczej, uległy one znacznym uszkodzeniom. Na podstawie przeprowadzonej inwentaryzacji uszkodzeń, przeanalizowano usytuowanie powstałych spękań w kontekście zaistniałych deformacji terenu. W zakończeniu podano wnioski dotyczące dylatowania utwardzonych placów i obejść na terenach górniczych.

The article concerns the problem of appearance of damages and deformations of hardened squares, internal roads and by-passes of buildings, caused by the impacts of mining operations on the surface. In the work the previously and currently applied methods of hardening of large squares were discussed. An example of building development was given, within which surfaces of considerable sizes were hardened. As a result of previously and currently conducted mining exploitation they were subjected to considerable damages. On the basis of performed inventorying of damages, the location of arisen fractures in the context of coming into being ground deformations was analysed. Finally, conclusions concerning the dilatation of hardened squares and by-passes in mining areas were given.
