Transport jest jednym z podstawowych działów gospodarki światowej i ma on fundamentalny wpływ na jej rozwój oraz rozwój całej cywilizacji. Sytuacja wygląda podobnie również w Polsce. Sprawnie i efektywnie działający transport stanowi bowiem podstawę do rozwoju innych dziedzin gospodarki. W szczególności dotyczy to transportu towarowego, którego zadaniem jest sprawne, szybkie i tanie przemieszczanie różnego typu towarów. Można założyć, że podstawą dobrze działającej gospodarki rynkowej jest efektywny transport. Aby spełniał on swoją role w gospodarce, muszą być spełnione określone warunki. Jednym z nich są uwarunkowania prawne dotyczące czasu pracy kierowców w przedsiębiorstwach transportowych. Praktyka pokazuje, że w tym obszarze występują poważne problemy związane z obowiązującymi regulacjami prawnymi, które w istotny sposób utrudniają prace kierowców oraz przedsiębiorstw transportowych. W artykule skoncentrowano się na wyjaśnieniu tego problemu. W tym celu przeprowadzono badania ankietowe wśród kierowców oraz właścicieli przedsiębiorstw transportowych. Na podstawie uzyskanych wyników podjęto próbę określenia, jak obecne uwarunkowania prawne są przestrzegane przez kierowców oraz jaki mają wpływ na efektywność przedsiębiorstw transportowych. Otrzymane wyniki dowodzą, że w wielu przedsiębiorstwach przepisy te stanowią poważną barierę rozwoju.

Transport is one of the basic sectors of the global economy. It has a fundamental impact on the development of the global economy as well as the entire civilization. The importance of transport for economic development in Poland is also enormous since efficiently and effectively operating transport is the basis for the advancement of other sectors of the economy. In particular, it concerns freight transport, which task is to move various types of goods efficiently, quickly and cheaply. It can be assumed that effective transport is the key to a well-functioning market economy. However, to fulfil its role in the economy certain conditions must be met. One of them are legal conditions concerning drivers’ working time in transport companies. Practice shows there are serious problems in this area. They are related to the applicable legal regulations, which significantly impede the work of drivers and transport companies. The article focuses on explaining this problem. For this purpose, a survey was conducted among drivers and owners of transport companies. Based on the results obtained, an attempt was made to determine how current legal conditions are observed by drivers and what impact they have on the efficiency of transport companies. The obtained results prove that in many enterprises these provisions constitute a serious barrier to their development.

The article describes the transport process and the drivers’ approach with regard to respecting the applicable driver's working time standards. This paper presents and discusses the results of a survey conducted among professional drivers, the primary purpose of which was to obtain the response to the question whether drivers actually rest during the break. Legal regulations strictly determine the minimum daily and weekly rest periods and the maximum daily and weekly driving times. Appropriate advanced technologies represented by measuring tools to the great extent oblige drivers to take a rest at the right time. Nevertheless, on the basis of the research it was stated that drivers frequently execute other activities, thus trying to increase their profits during break time, and therefore they commit for a rest shorter time than this resulting from the current working time regulations. The introduction of newer and more advanced solutions in the recording equipment substantially limits the possibility of performing other activities related to the vehicle during a break, and forces drivers to have a rest, thereby they pose less risk on the roads.

W artykule omówiono normy prawne regulujące czas pracy kierowców samochodów o nośności powyżej 3,5 tony oraz urządzenia stosowane do rejestracji czasu ich pracy. Okazuje się, że w praktyce regulacje te stwarzają dla kierowców wiele problemów. Powoduje to, że czasami podejmowane są próby omijania tych przepisów. W pracy przedstawiono przykłady działań związanych z tym procesem. Dotyczą one głównie ingerencji w pracę urządzeń rejestrujących parametry jazdy samochodem. Przykłady te dotyczą typowych działań podejmowanych w stosunku do tachometrów samochodowych. Należy podkreślić, że są one niezgodne z przepisami i podlegają stosownym karom. Nie mniej w praktyce zdarzają się dość często. Głównym celem pracy było przybliżenie zasad i unormowań obowiązujących w transporcie samochodowym oraz problemów technicznych związanych z ich stosowaniem.

In the article, there are presented the discussion of the legal standards governing the working time for car drivers with a capacity of over 3.5 tones and the equipment used to record of their work time. In practice, these regulations pose many problems for drivers. This makes that sometimes attempts are made to avoid these rules. The paper presents examples of activities related to this process. These actions mainly concern the interference in the operation of recording equipment the limits of driving the car. These examples illustrate the typical activities undertaken with respect to car tachometers. It is important to point out that they are illegal and subject to appropriate penalties. It is important, that they are illegal and subject to appropriate penalties. Nevertheless, in practice there often occur. The aim of the article was to approximate the rules and regulations governing of car transport and the technical problems related to their use.

Transport is one of the main components in the logistics business. With the accession to the European Union Polish Polish state has undertaken to adapt to EU regulations including drivers' working time is regulated on the basis of regulations and directives of the Union. It is defined as working time from start to finish all the tasks that are associated with the performance of road transport. These activities are related to: driving, as well as the loading and unloading (without having to perform these operations personally by the driver), forwarding operations and daily maintenance of vehicles, trailers and other works that are being taken to ensure the safety of transport and the cleanliness of the vehicle or performance of official business, and the necessary administrative formalities. The paper presents a method of controlling the working time driving through the use of analogue and digital tachographs. Presented Tachograph system performance and the ability to use TachoScan for analyzing and archiving data sheets.

Transport stanowi jeden z głównych komponentów w działalności logistycznej. Wraz z przystąpieniem Polski do Unii Europejskiej państwo polskie zobowiązało się dostosować do przepisów unijnych w tym także czas pracy kierowców został uregulowany na podstawie rozporządzeń oraz dyrektyw Unii. Definiuje się go jako czas pracy od rozpoczęcia do zakończenia wszystkich czynności, które związane są z wykonywaniem przewozu drogowego. Czynności te związane są z: prowadzeniem pojazdu, jak również z jego załadowywaniem i rozładowywaniem (bez konieczności wykonywania tych czynności osobiście przez kierowcę), czynności spedycyjne i obsługę codzienną pojazdów, przyczep oraz inne prace, które podejmowane są w celu zapewnienia bezpieczeństwa przewozu oraz czystości pojazdu lub wykonania zadania służbowego oraz niezbędne formalności administracyjne. W pracy przedstawiono metody kontroli czasu pracy kierowcy poprzez wykorzystanie tachografów analogowych oraz cyfrowych. Zaprezentowany działanie systemu tachograficznego oraz możliwość wykorzystania programu tachoscan do analizowania i archiwizowania danych z wykresówek.
