W artykule dokonano wykładni przepisu art. 92 ust. 1 ustawy o gospodarce nieruchomościami, w którym ustawodawca określając przedmiotowy zakres regulacji określających zasady dokonywania podziałów nieruchomości zastosował technikę legislacyjną a contrario (wielokrotną negację), czyniąc ten tekst wyjątkowo nieczytelnym i językowo niezrozumiałym. Wnioski wynikające z przeprowadzonej analizy, z wykorzystaniem dyrektyw wykładni językowej i systemowej, pozwoliły na ustalenie rozumienia zakodowanej w nim normy prawnej i usunięcia wątpliwości dotyczących możliwości zastosowania ich w praktyce, tak aby były one spójne i zrozumiałe. Wykazano m.in., iż z „koniecznością wydzielenia nowych dróg”, o której mowa w art. 92 ust.1 tej ustawy mamy do czynienia wówczas, gdy w trakcie podziału nieruchomości nierolnej lub nieleśnej zachodzi potrzeba wydzielenia z terenów rolnych lub leśnych nowych dróg wewnętrznych, które zapewnić mają tym działkom dostęp do drogi publicznej.

The article interprets the provision of Art. 92 sec. 1 of the Real Estate Management Act, in which the legislator, while specifying the subject scope of the regulations specifying the rules for dividing real estate, applied the a contrario legislative technique (multiple negation), making this text exceptionally illegible and linguistically incomprehensible. Conclusions resulting from the analysis carried out, with the use of linguistic and systemic interpretations directives, made it possible to establish the understanding of the legal norm encoded in it and to remove doubts regarding the possibility of applying them in practice, so that they were consistent and understandable. It has been shown, among others, that with the "need to separate new roads", referred to in Art. 92 (1) of this Act, we are dealing with the situation when, during the division of non-agricultural or non-forest real estate, there is a need to separate new internal roads from agricultural or forest areas, which are to provide these plots with access to a public road.
