Postępowanie z rowami w prowadzeniu operatu ewidencji gruntów i budynków, często cechowało się brakiem podstaw prawnych do przeprowadzanych działań przez wykonawców prac geodezyjnych i organ prowadzący ewidencję gruntów i budynków. Interpretacja lub pismo nadrzędnego organu lub nadzoru geodezyjnego decydowało, czy rów był zakwalifikowany jako działka ewidencyjna czy jako użytek rolny oraz kto stawał się jego właścicielem. Zmiana rozporządzenia w sprawie ewidencji gruntów i budynków, jaka weszła w życie 31.12.2016 r., dodatkowo poprzez nową definicję tego użytku, skomplikowała sprawę w procedurze modernizacji operatu ewidencji gruntów i budynków. W artykule przedstawiono przepisy, stanowiska oraz tryby postępowania w przeszłości w zakresie rowów oraz zaproponowano działania w trybie bieżącej aktualizacji i modernizacji ewidencji gruntów i budynków zmierzającej do utworzenia Zintegrowanego Systemu Informacji o Nieruchomościach.

Procedures concerning ditches in the process of development of documentation of the land and buildings registration were often characterised by the lack of legal basis for actions carried out by the contractors of surveying works and the authority responsible for the land and buildings registration. Interpretation or a notice in writing from a supervising unit decided whether the ditch could be qualified as a cadastral parcel of land or as an agricultural land and who became its owner. Modification of the regulation on the land and buildings registration which entered into force on 31 December, 2016, additionally complicated the problem in the procedure of modernisation of the documentation of the land and buildings registration; it results from the new definition of the discussed pieces of land. The paper presents the rules, positions and modes of conduct applied in the past in relation to ditches and it also suggests actions to be undertaken as the current updating and modernisation of the land and buildings registration aiming at the establishment of the Real Property Integrated Information System.
