Przedmiotem artykułu jest analiza pojęcia armatora, którego użyto w ustawie o żegludze śródlądowej. W opracowaniu dokonano rozróżnienia terminu „armator” występującego w Kodeksie morskim oraz w ustawie o żegludze śródlądowej. Wskazano m.in., że definicja zawarta w tym drugim akcie prawnym jest wprawdzie bardzo szeroka, jednak nieprecyzyjna. Dla zrozumienia analizowanego pojęcia nie można także korzystać z Kodeksu morskiego. W przeciwieństwie do niego ustawa o żegludze śródlądowej w większym stopniu uzależnia przesłanki „bycia” armatorem od treści zawartej między stronami umowy. W opracowaniu skoncentrowano się także na różnicach pomiędzy pojęciem statku morskiego a statku śródlądowego.

The subject of this article is the analysis of the notion of “armator” (an inland waterway vessel operator) used in the Inland Waterways Act. It is argued that there is a distinction between the notion of “armator” used in the Maritime Code Act and the same word being used for the purpose of the Inland Waterways Act. It was shown that the definition of “armator” in the Inland Waterway Act is broad but imprecise. Moreover, the Maritime Code Act cannot serve as a reference to get a better understanding of this notion. It was presented that contrary to the Maritime Code Act, the attributes pertaining to “armator”, according to the Inland Waterways Act, depend more on the content of a particular contract “armator” entered into. The article focuses also on the differences between “statek morski” (a ship) and “statek śródlądowy” (an inland waterway vessel). We have suggested some criteria that may make the distinction between “statek morski” (a ship) and “statek śródlądowy” easier.
