The article presents an analysis of military law in the legal system of the Republic of Poland. On the one hand, it is a very specialized area of law, and on the other, it is a very extensive field regulated in several hundred national legal acts of varying importance (universally and internally binding), as well as by international law. The author attempts to organize the subject matter of military law and to specify its elements divided into subject-specific blocks. At the same time, in order to ensure a better understanding of the nature of military law, the article discusses the role of the Armed Forces of the Republic of Poland in times of peace, crisis, and war. The author used critical analysis of literature on legal science and security sciences, and source materials: mainly acts of universally binding law (the Constitution, acts, and regulations), as well as acts of internally binding law (instructions, ordinances, resolutions, decisions, guidelines, and agreements of various state authorities).

Celem artykułu jest przedstawienie związków i zależności, jakie występują pomiędzy prawem obronnym, w tym prawem morza, a bezpieczeństwem, ze szczególnym uwzględnieniem bezpieczeństwa morskiego i bezpieczeństwa morskiego państwa. Aby to uczynić, nieco więcej miejsca autor przeznacza na omówienie istoty zagrożeń współczesnych i bezpieczeństwa oraz jego subkategorii, związanych zwłaszcza z bezpieczeństwem morskim. Wyjaśnia także, jak należy rozumieć pojęcia prawo obronne i będące jego częścią składową prawo morza. W artykule potwierdzona została dość oczywista teza, z której wynika, że pomiędzy bezpieczeństwem i jego subkategoriami (także morskimi) a prawem obronnym (w tym prawem morza) istnieją dwojakiego rodzaju relacje (zależności) – bezpośrednie i pośrednie. Na czym te relacje polegają, stanie się dla Czytelnika oczywiste, jeżeli podejmie trud związany z lekturą niniejszego artykułu.

The purpose of the paper is present relationships and dependences which occur between the defense law, including law of the sea, and the security, paying main attention to maritime security and state maritime security. In order to do that, the author dedicates more space to considering the nature of contemporary threats, and security and its subcategories, connected mainly with maritime security. He also explains how to understand the notion of defense law and the law of the sea, which is its part. The paper confirms a fairly obvious thesis from which a conclusion is drawn that there exists relationships of dual kind between security and its subcategories (including maritime ones), and defense law (including law of the sea) — direct and indirect. What these relationships are will become obvious for the Reader if he/she makes an effort to read the paper.
