Railway infrastructure access rates, as an important element of the costs affecting the services offered to railway clients, are an object of interest in the context of transport sustainability and the promotion of railway transport. The pandemic caused by the SARS-CoV-2 coronavirus has spawned a crisis that has affected the railway sector in a significant way. In October 2020, the European Commission published a Regulation establishing measures for a sustainable rail market in view of the COVID-19 pandemic. The European Commission’s initiative of introducing a Regulation allowing for derogations from existing laws, as well as satisfying the urgent needs of the railway sector for the duration of the effects of the pandemic, may be a significant step towards a permanent leveling of the playing field for all of the branches competing in the transport sector. This article presents information in terms of the legal regulations concerning the charges for infrastructure use and outlines the assumptions of Regulation 2020/1429 (EU) of the European Parliament and of the Council.

19 czerwca 2020 roku Komisja Europejska opublikowała projekt Rozporządzenia ustanawiającego środki na rzecz zrównoważonego rynku kolejowego w związku z pandemią COVID-19 COM(2020) 260, w którym między innymi zaleca państwom członkowskim obniżenie, odroczenie a nawet całkowite zniesienie opłat dla przewoźników kolejowych za korzystanie z infrastruktury kolejowej a ponadto uchylenie opłat za rezerwację. Rozporządzenie to jest uzupełnieniem istniejących ram prawnych w dziedzinie kolei dla umożliwienia łatwiejszego radzenia sobie ze skutkami pandemii oraz zaspokojenia pilnych potrzeb sektora kolejowego przez cały okres oddziaływania tych skutków. W artykule przedstawiono kontekst rynkowy, kontekst prawny oraz proponowane, najważniejsze zapisy mogące przynieść korzyści zarówno świadczącym usługi na rynku kolejowym, jak i ich beneficjentom.

On June 19, 2020, the European Commission published a draft Regulation establishing measures for a sustainable railway market in connection with the COVID-19 pandemic COM (2020) 260, in which, inter alia, it recommends Member States to reduce, postpone or even completely abolish charges for railway carriers for the use of railway infrastructure and also waiving booking fees. This regulation complements the existing legal framework in the field of railways to enable the effects of a pandemic to be dealt with more easily and to meet the urgent needs of the rail sector throughout their impact period. The article presents the market context, the legal one and the proposed, most important provisions that may bring benefits to both service providers on the railway market and their beneficiaries.
