The purpose of this article is to present the amendment to the Construction Law, effective as of 19 September 2020, which introduced Articles 53a and 72a to the Construction Law, according to which proceedings for violations of the Construction Law, i.e. in cases of self-construction and in cases of maintenance of buildings, are initiated ex officio. This article is a continuation of the subject matter undertaken in the journal Construction and Law No. 4/2022. In this paper, the author, noting that the legislator has excluded the principle of complaint in these proceedings, argues that nowadays proceedings conducted by the construction supervision authorities in the cases specified in Articles 53a and 72a should be initiated only ex officio.

In response to the post-war mechanisation and electrification of the mining industry, the Mining Office for the Inspection of Energy-Mechanical Equipment in Katowice was established in 1957, with local jurisdiction over the entire country, which was renamed the Specialised Mining Authority in 2012. Its material jurisdiction, as mining supervisory authorities and architectural and construction administration and construction supervision in the mining industry, was defined successively by ordinances: President of the Council of Ministers and the Ministers of the Internal Affairs and Administration and the Environment, and finally the Act - Geological and Mining Law. The Specialised Mining Authority was abolished on 19 October 2022. The core activities of the SGGUE/SUG were of a control and supervisory and preventive nature. Its staff performed inspections of technical facilities and monito¬red selected issues. The director of the authority also issued permits for the commissioning of facilities and, in the field of construction, acted in accordance with the building regulations. Thanks to the authority's efforts, mining facilities have made numerous upgrades. For example, open construction switchgear has been replaced by closed construction switchgear. In 2021, the SUG's jurisdiction covered 39 underground mines. The office's supervision included: 261 shafts and small shafts, 319 mine shaft lifts, 8 pieces of equipment, running on a track with an in¬clination of more than 45°, and 88 main fan stations (208 fans), 387 internal high and medium voltage electrical installations and networks, 49 control rooms, 67 control rooms, as well as 1993 building structures.

Artykuł przedstawia działalność i kolejne zmiany właściwości rzeczowej utworzonego w 1957 r. Urzędu Górniczego do Badań Kontrolnych Urządzeń Energo-Mechanicznych, w 2012 r. przemianowanego na Specjalistyczny Urząd Górniczy, a następnie zlikwidowanego 19 października 2022 r. Jego właściwość rzeczową, jako organu nadzoru górniczego oraz administracji architektoniczno-budowlanej i nadzoru budowlanego w górnictwie, określało kolejno 7 rozporządzeń: Prezesa Rady Ministrów oraz ministrów Spraw Wewnętrznych i Administracji oraz Środowiska, a finalnie ustawa - Prawo geologiczne i górnicze.

Utworzony w 1928 roku nadzór budowlany, którego zadaniem było czuwanie nad bezpieczeństwem i porządkiem publicznym w procesie budowlanym, ulegał istotnym zmianom zarówno w zakresie struktury organizacyjnej, jak i w zakresie katalogu powierzonych do realizowanych zadań. Na kształt obecnie funkcjonującego nadzoru budowlanego decydujący wpływ miały przede wszystkim przekształcenia ustrojowe, jakie zaszły w Polsce w 1989 r., a które doprowadziły do odbudowy samorządu terytorialnego. Wdrożenie reformy ustrojowej państwa, w tym wprowadzenie trójstopniowego podziału administracyjnego kraju, skutkowało dokonaniem podziału administracji państwowej działającej w dziedzinie budownictwa na dwa odrębne piony: organy administracji architektoniczno-budowlanej oraz organy nadzoru budowlanego. Podział ten, pomimo pojawiającej się krytyki odnośnie skuteczności działania tych organów, nadal obowiązuje.

The construction supervision, established in 1928, whose task was to ensure security and public order in the construction process, underwent significant changes both in terms of the organizational structure and the catalog of entrusted to fulfill tasks. However, the shape of the currently functioning construction supervision was primarily influenced by the political transformations that took place in Poland in 1989 and which led to the reconstruction of the local government. The implementation of the state system reform, including the introduction of a three-level administrative division of the country, resulted in the division of the state administration operating in the field of construction into two separate divisions: architectural and construction administration bodies and construction supervision bodies. This division, despite the emerging criticism regarding the effectiveness of these bodies, still applies.

Ustawa Prawo budowlane reguluje zakres uprawnień i kompetencji organów nadzoru budowlanego w Polsce. Podstawowym działaniem inspekcji budowlanej jest przede wszystkim czuwanie na prawidłowością procesu inwestycyjnego. Artykuł przedstawia problematykę powstałą na etapie wszczęcia postępowania administracyjnego przez organy nadzoru budowlanego. Kwestia wszczynania przez organy nadzoru budowlanego postępowań wywoływała rozbieżności w stanowisku judykatury, a także doktryny w ramach dopuszczalności wszczęcia postępowań na wniosek.

The Construction Law regulates the scope of power and competencies of construction supervision authorities in Poland. The primary task of the construction supervision is to watch over the correctness of the investment process. The article presents the problems appearing at the beginning of the administrative proceedings initiated by the construction supervision authorities. The issue of initiating proceedings by the construction supervision authorities raised discrepancies in the judicature, as well as the doctrine, regarding the permissibility of initiating these proceedings upon application.

Organy nadzoru budowlanego są wyposażone w szerokie uprawnienia, umożliwiające realizację działań kontrolnych ukierunkowanych na usuwanie zagrożenia bezpieczeństwa w procesach realizacji i eksploatacji obiektów budowlanych. W referacie podano uwarunkowania prawne tych działań oraz informacje statystyczne ich skutków w latach 1995–2015 – wskazujące na wyeliminowanie z naszego środowiska licznego zbioru różnych obiektów budowlanych zagrażających bezpieczeństwu ludzi, mienia i środowiska.

Construction supervision authorities are equipped with broad powers, enabling implementation of control measures aimed at removing security threats in the process of implementation and operation of buildings. In the paper are given legal conditions of these activities and their effects statistical information for the years 1995-2015, indicating the elimination of our environment numerous collection of different buildings that threaten the safety of people, property and the environment.
