Mining supervision authorities provide information on their activities pursuant to the Act on Access to Public Information and specific acts. The provisions guarantee access to this information to everyone through official publications, especially the online Public Information Bulletin, and by way of responding to individual requests. Public information is everything that is directly related to the activities of public authorities and entities performing public tasks, excluding internal working documents and strictly personal information. The most important role is played by access to official documents, including decisions in administrative and court proceedings. A distinction is made between simple information, generated as part of the tasks performed, and processed information, developed on the basis of simple information in cases of particular importance for the public interest. The provisions may specify different rules for disclosing public information depending on its subject (e.g. in the case of files of proceedings, recruitment for positions in the civil service or information on the environment) and may introduce restrictions on access to this information (e.g. due to legally protected secrets or personal privacy). Obtaining public information does not require the applicant to meet complicated requirements, it should take place immediately or within the time limits provided for by law. Refusal or failure to provide information is subject to administrative and judicial review and may result in administrative and criminal sanctions. Abuse of the right to public information, obtained contrary to its purpose, allows for refusal to disclose it.

Artykuł prezentuje podstawy systemu udostępniania informacji publicznej w Polsce, w szczególności przedmiot tej informacji, akty prawne regulujące jej udostępnianie, formy udostępniania, tryb udostępniania informacji na indywidualny wniosek, przewidziane w przepisach odrębnych wyłączenia i odmienności w stosowaniu przepisów o udostępnianiu informacji publicznej, sankcje za nieudostępnienie informacji publicznej i instytucję nadużycia prawa do informacji publicznej.

Perspectives and development of the Bulgarian military-educational system

The report presents all the current challenges which the Bulgarian military-educational system is facing in the context of the basic features of the security environment and trends for the first half of the 21th century by identifying the main problem areas in its functioning. The status and capabilities of the military-educational system of the Republic of Bulgaria are discussed on the basis of an analysis of key strategic documents in the sectors of education, security and defence, as well as the current state of military and civil education and the inherent activities of the training institutions. Outlined are the basic principles of construction and operation of military-educational systems and the fundamental strategic goals and tasks according to modern strategic security environment and dynamically changing conditions in NATO and the EU. Described are the main elements of the military-educational system as a complex, adaptive and flexible system that develops in unity and complementarity with the system of civil education in Bulgaria. Guidelines are formulated for improving the military educational system in relation to its contribution to strengthening national security and defence of the country in three directions – conceptual, organizational and technological improvement.

Raport przedstawia wszystkie aktualne wyzwania stojące przed bułgarskim systemem szkolnictwa wojskowego w kontekście podstawowych cech środowiska bezpieczeństwa i trendów pierwszej połowy XXI wieku poprzez identyfikację głównych obszarów problemowych w jego funkcjonowaniu. Status i możliwości systemu szkolnictwa wojskowego w Republice Bułgarii są omówione w oparciu o kluczowe dokumenty strategiczne w sektorach edukacji, bezpieczeństwa i obrony oraz obecny stan edukacji wojskowej i cywilnej oraz nieodłączne działania instytucji szkoleniowych. Przedstawiono podstawowe zasady konstruowania i działania systemów edukacji wojskowej oraz fundamentalne cele strategiczne i zadania w korelacji ze współczesnym środowiskiem bezpieczeństwa strategicznego i dynamicznie zmieniającymi się warunkami w NATO i UE. Główne elementy systemu edukacji wojskowej zostały opisane jako złożony, zdolny do adaptacji, elastyczny system rozwijający się zgodnie i komplementarnie z cywilnym systemem edukacji w Bułgarii. Sformułowano wytyczne dotyczące ulepszenia systemu szkolnictwa wojskowego w Bułgarii w odniesieniu do jego wkładu we wzmocnienie bezpieczeństwa narodowego oraz obronności w trzech kierunkach – rozwoju konceptualnego, organizacyjnego i technologicznego.

Autor przez analizę zapisów zawartych w kodeksie karnym, jak i dokumentach z zakresu prawa międzynarodowego, przedstawia niecelowość stosowania wzmocnionych przesłuchań (tortur) wobec zatrzymanych osób podejrzanych o terroryzm. Zwraca uwagę, że takie działania obnażają słabości merytoryczne funkcjonariuszy organów ścigania dokonujących przesłuchań. Przestrzega, że tortury stosowane wobec terrorystów zamieniają się w tortury stosowane wobec domniemanych terrorystów, następnie wobec wrogów społeczeństwa, następnie wobec wrogów władzy i w konsekwencji zawsze miejsce terrorysty zajmuje opozycjonista i zwykły obywatel.

Enhanced interrogation techniques are known to be used by some secret and intelligence services in order to gather information about terrorism activities. Purpose of an article is to answer whether and if so to what extent these techniques could be used as an effective element of combating terrorism in the democratic rule of law state. To answer this research question Author conducts analysis of legal and scientific documents and a study of differences and similarities between Polish and American law and evaluates interrogation process of Aby Zubaydaha and other suspects of terrorism activities.
