Artykuł zawiera wyniki badań dotyczące analizy materiałów zasobu w odniesieniu do granic działek ewidencyjnych i form dokumentowania jej wyników. Badania dotyczyły sposobów dokumentowania wyników analizy materiałów zasobu w operatach technicznych przyjętych do Państwowego Zasobu Geodezyjnego i Kartograficznego. Przedstawiono propozycję formy dokumentowania wyników analizy materiałów zasobu w sprawozdaniu technicznym. Wyjaśniono, co należy rozumieć pod pojęciem aktualności, dokładności i kompletności w odniesieniu do oceny przydatności materiału zasobu do osiągnięcia celu zgłoszonej pracy geodezyjnej.

The article contains results of research regarding the analysis of resource materials in relation to the borders of land parcels and forms of documenting its results. The research concerned methods of documenting the results of the analysis of resource materials in technical reports adopted for the State Geodetic and Cartographic Resource. A proposal was presented for the form of documenting the results of the analysis of resource materials in a technical report. It was clarified what is meant by timeliness, accuracy and completeness in relation to the assessment of the suitability of the resource material to achieve the purpose of the reported surveying work.

Land consolidation plays an important role in rural areas management by stimulating the areas to develop and contributing in particular to the creation of favourable conditions for agriculture. Land consolidation process enables to form a new state of ownership and is crucial for the improvement of area structure of Polish agricultural holdings. Efficient rural areas management necessitates reliable information about property boundaries. Determination of property rights requires a precise space delineation of those rights by establishing the position of parcel boundaries, which determines future land utilization and possible directions of property development. Clear, unequivocal and reliable establishment of boundaries determines the feasibility of future investments, particularly in the field of technical and social infrastructure. The paper presents technological and legal aspects of the performance of geodetic works concerning the establishment of the position of boundary points in the proceedings of land consolidation. In the study there were examined existing legislation and technical regulations relating to the process of land consolidation. The records were examined in terms of land demarcation procedure, led particularly by district governor, in relations to the outer boundaries of land consolidation area and in terms of establishment, indication and marking on the ground of newly planned boundary points, resulting from land consolidation project. Theoretical research was confronted experimentally based on the selected land consolidation object. Conducted theory and practice research allowed to submit proposals for changes to the binding land consolidation procedure.

W artykule przedstawiono propozycję zmiany istniejącego modelu katastru nieruchomości, zmierzającą do objęcia ujawnianych w rejestrze granic działek ewidencyjnych instytucją domniemania prawdziwości i wiarygodności publicznej. Stworzenie odpowiedniego modelu, w ramach którego rejestrowane byłyby dane ewidencyjne pozyskane w wyniku ustalonych prawem procedur, przy zachowaniu obowiązujących standardów technicznych, mogłoby stworzyć warunki do wyodrębnienia z istniejących baz danych rejestrów granicznych, które spełniałyby wymagane warunki sine qua non uzależniające objęcie ich domniemaniem prawdziwości i wiarygodności. Tak zdefiniowany kataster nieruchomości stanowić powinien wraz z księgami wieczystymi istotny systemowy element pozwalający na utrzymanie ładu prawnego na gruncie.

This article presents a proposal to amend the existing model of the cadastre of real estate aiming to include exposed cadastral parcels in the border register by the presumption of correctness of the institution and the credibility of the public. The creation of an appropriate model, in which the recorded data would be obtained as a result of established legal procedures, while maintaining the existing technical standards, could create conditions to extract data from existing database of border registers that would meet the required conditions sine qua non needed to include them with validity and reliability. Cadastre of real estate so defined, shall constitute along with the land and mortgage register, an important element of the system to keep the order on legal grounds.

Według obowiązujących w Polsce przepisów, granice działek w ewidencji gruntów i budynków ujawnia się na podstawie dokumentacji powstałej w postępowaniach rozgraniczeń nieruchomości, podziałów nieruchomości, scaleń i wymiany gruntów, scaleń i podziałów nieruchomości, innych postępowań sądowych lub administracyjnych oraz na podstawie dokumentacji powstałej w wyniku pomiarów związanych z zakładaniem ewidencji gruntów i budynków Granice działek wykazane na podstawie wymienionych procesów przedstawiają niejednoznaczności. Przebieg granic działek należy postrzegać w przestrzeni technologiczno prawnej, na którą składa się podprzestrzeń technologiczna (związana z pomiarem i możliwością jednoznacznego odtworzenia przebiegu granic) oraz podprzestrzeń prawna (związana z prawnym zatwierdzeniem określonego położenia linii granicznych). Spójność przestrzeni technologiczno prawnej rozumie się jako obszar części wspólnej obu podprzestrzeni. Badana przestrzeń działek ujawnionych w ewidencji gruntów i budynków zawiera niespójności, które są sprzeczne z wymaganiami współczesnego katastru nieruchomości. Praca jest próbą systematyzacji pojęć oraz wstępem do analizy niespójności przestrzeni technologiczno- prawnej w postępowaniach związanych z ustalaniem przebiegu granic działek w aspekcie wymagań, jakie powinien spełniać współczesny kataster nieruchomości.

According to Polish regulations, borders of lands parcels in land registration are recorded on base of documentation established in procedures of delimitation of a real estate, division of a real estates, consolidation and exchange of agricultural plots, consolidation and division of a real estates, other judicial or administrative procedures and on base of documentation in result of measurements related with set-up of land registration. Borders of lands parcels established within above mentioned process present ambiguities. Course of borders of lands parcels should be perceived in technologically-legal area, which consists of technological area (connected with surveys and capability to unequivocal recovery borders of lands) and legal area (connected with legal approval borders of lands). Cohesion of technologically-legal area is understood as a common area of both areas. Researched area of borders of lands parcels recorded of land registration includes ambiguities which are in contradiction to the modern requirements of cadastre. This article is an attempt to systematize of notion and introduction to analysis of incoherence of technologically-legal area in procedures related to the location of boundaries in aspect of the modern requirements of cadastre.
