Glosa dotyczy problematyki błędu na gruncie regulacji z art. 178a § 1 k.k., w rozumieniu art. 28 § 1 k.k. Autor zwraca uwagę nie tylko na brak podstaw do uznania, że kasacja była oczywiście bezzasadna, ale też na brak możliwości racjonalnej wykładni obowiązujących przepisów. Gdyby bowiem przyjąć, że istnieje możliwość rozgraniczenia znamion „stan pod wpływem środków odurzających” i „stan po użyciu środków działających podobnie do alkoholu”, to i tak nie można wymagać, aby oskarżony miał świadomość, w jakim stanie w danej chwili się znajduje. W rezultacie wyrok Sądu Okręgowego w S. z 23 marca 2017 r. był „jawnie sprzeczny z zasadami praworządnego i sprawiedliwego procesu”.

The commentary concerns the problem of error under the regulations of art. 178a of the Penal Code, within the meaning of art. 28 § 1 of the Penal Code. The author draws attention not only to the lack of grounds for considering that the revocation was obviously unfounded, but also to the lack of rational interpretation of the applicable provisions. Should a possibility of separating the characteristics of “state under the influence of intoxicants” and “state after the use of agents which have similar effects to alcohol” be assumed, the accused cannot be required to be aware of what state he is in at a given moment. As a result, the judgement of the District Court in S. of 23 March 2017 was “evidently contrary to the law-based and fair trial”.

Initiation of damage to the hot part of aircraft turbine engines

In the paper, the initiation causes of damage to flame tubes of a basic combustion chamber and turbine units, which are the most common in the operation process of aircraft turbine engines (ATE), were presented. They were illustrated with the use of numerous examples of progressing degradation of the surface condition of parts and components of various types of aircraft engines which was found during endoscopic controls. On the basis of the systematic observation results, the process of destruction of the turbine rotor ring blades’ surface was discussed. The attention was paid to the current and still valid evaluation of the aircraft turbine engine’s suitability for further operation, taking into account the specifics of its use.

W artykule autorzy zwrócili uwagę na najczęściej spotykane w procesie eksploatacji lotniczych silników turbinowych (LST) przyczyny inicjacji uszkodzeń elementów rur żarowych zasadniczej komory spalania i zespołów turbin. Zostały one zilustrowane licznymi przykładami stwierdzanej podczas wykonywania kontroli endoskopowych postępującej degradacji stanu powierzchni części i podzespołów różnego typu silników lotniczych. Omówiono na przykładzie wyników systematycznej obserwacji proces niszczenia powierzchni łopatek wieńca wirnika turbiny. Zwrócono uwagę na dotychczasowy i nadal obowiązujący sposób oceny przydatności LST do dalszej eksploatacji z uwzględnieniem specyfiki jego użytkowania.

The paper has been intended to draw attention to some causes of the initiation of failures to components of flame tubes of the combustion chamber and turbine units, ones most often occurring throughout the process of operating aircraft turbine engines. They have been illustrated with multiple examples of degradation of surfaces of structural components and/or subassemblies, usually found during visual inspections of various types of aircraft engines. With results of systematic observations applied, the process of destruction of surfaces of blades in the turbine rotor blading has been discussed. Attention has also been paid to the way of evaluating the suitability of a given engine for further operation, the method that has hith-erto been used and remains in force all the time.
