W artykule dokonano analizy orzecznictwa sądów powszechnych i KIO dotyczącego wynagrodzenia za roboty dodatkowe towarzyszące realizacji zamówień publicznych w formule „wybuduj”, tj. w przypadku, kiedy to na zamawiającym spoczywa obowiązek dostarczenia wykonawcy dokumentacji umożliwiającej osiągnięcie rezultatu umowy o roboty budowlane. Dodatnią wartość artykułu stanowi analiza sporów ekonomicznych w zakresie alokacji ryzyk pomiędzy strony umowy w zakresie finansowania robót budowlanych, których nie wyszczególniono w sposób jasny w opisie przedmiotu zamówienia.

In this article an analysis of the jurisprudence of common courts and the National Appeals Chamber regarding remuneration for additional works accompanying the execution of orders in the „build” formula, i.e. when the contracting authority is obliged to provide the contractor with documentation to achieve the result of the construction contract. The positive value of the article is the analysis of economic disputes in the field allocation of risks between the parties to the contract regarding the financing of construction works, which are not clearly specified in the description of the subject of the contract.

One of the reasons for the contractors of public contracts for construction works to earn a lower margin than assumed at the stage of calculation of the offer price (in particular the lump sum) is the performance of additional works based on oral arrangements with persons (e.g. investor supervision inspector) who do not have the legal obligation to incur financial liabilities on behalf of and for the contracting authority, and lack of effectiveness in claiming additional remuneration on this account. The article presents and analyzes the instruments giving contractors a legal basis to make cost claims in the event of the need to perform additional works related to the implementation of the contract concluded within the provisions of the Act of 11/09/2019 - Public Procurement Law, settled on a flat-rate basis.

Artykuł prezentuje autorskie podejście do oceny ryzyka robót dodatkowych w przedsięwzięciach kolejowych. Opracowana baza danych posłużyła do budowy i kalibracji modelu w postaci sieci bayesowskiej. Zdefiniowano kluczowe zdarzenia dotyczące robót dodatkowych. W przypadku każdego z nich określono warianty w węzłach sieci i prawdopodobieństwo ich wystąpienia. Zaproponowano 3 poziomy ryzyka. Przekroczenie przyjętego poziomu referencyjnego oznacza ryzyko nieakceptowalne i wymaga podjęcia działań zapobiegawczych.

This article presents a proprietary approach to the risk assessment of additional works in the railway construction projects. The developed database was used to build and calibrate the model as a Bayesian network. The key events causing additional works were defined. Variants in nodes of network and probability of occurrence were determined for each of them. Three levels of risk were proposed. Exceeding the defined reference level means an unacceptable risk and requires taking preventive actions.

In construction practice, contractually agreed costs are often exceeded, which interferes with the sustainable realization of construction projects. The research described in this paper covers 24 new construction, renovation and reconstruction projects in the Republic of Croatia realized in the years 2006 to 2017, in order to analyse the occurrence of cost overruns more precisely with regard to the source of the overruns. It was found that additional work is the main source of cost overruns: firstly, additional work as a result of the client’s change orders and then unforeseen construction work as a result of unforeseen circumstances. As for the additional works, they are carried out at the client’s request and are not necessary for the safety and stability of the building. Using linear regression and “soft computing” methods, the possibility of modelling the relationship between contractually agreed and realized construction costs with satisfactory accuracy was tested. The model with the values of the natural logarithms of the variables, modelled according to the time–cost model of Bromilow, proved to be of the highest accuracy.

Realizacja dużych inwestycji infrastrukturalnych w Polsce często wiąże się z wydłużonym czasem trwania robót budowlanych. W trakcie wykonywania prac budowlano-montażowych może pojawić się wiele zdarzeń mogących wpłynąć na czas i koszt całego przedsięwzięcia. Do takich zdarzeń zaliczyć można roboty dodatkowe, prace wcześniej nieprzewidziane, ale konieczne do wykonania. W artykule przedstawiono charakterystykę zjawiska oraz konsekwencje robót dodatkowych występujących w inwestycjach kolejowych obejmujących roboty budowlane. Autorzy zidentyfikowali czynniki będące przyczyną robót dodatkowych oraz podjęli próbę wskazania częstości ich występowania w omawianych inwestycjach kolejowych.

The implementation of large infrastructure investments in Poland is usually associated with an extended duration of construction works. Throughout the period of carrying out construction and assembly works, many factors may appear that may affect the time and cost of the entire project. Such situations include the occurrence of additional works that significantly affect the entire investment. The article will present the characteristics of the phenomenon and the consequences of additional works appearing in railway construction investments.

The railway construction investments are characterized by a significant extension of individual phases and an increased number of entities participating in the construction investment process. Despite the use of many modern methods and techniques unforeseen phenomena and events which may occur during the execution of the investment cannot be excluded. All unexpected situations usually initiate consequences in the form of additional workload and costs not included by the contractor and longer duration of works. This fact is commonly referred to as the occurrence of the so-called additional works. The paper presents the results of research concerning additional works occurring during the realization of railway construction projects performed in southern Poland. The analysis was based on data which concerned projects completed in the period from 1 January 2012 to 31 December 2018.

W artykule przedstawiono wpływ zmian zakresu prac przewidzianych w dokumentacji projektowej, wprowadzonych podczas realizacji prac remontowych, na termin zakończenia inwestycji, a także na jej koszt. Wprowadzanie robót dodatkowych nieujętych w projekcie w trakcie wykonywania prac remontowych wymaga od inwestora i wykonawcy dużej elastyczności, zaangażowania oraz doświadczenia, gdyż są one znacznym utrudnieniem w procesie inwestycyjnym. Prace budowlane nieuwzględnione w projekcie wpływają znacząco na czas realizacji i koszt całkowity inwestycji. Problem ten przedstawiono na przykładzie remontu budynku wzniesionego w latach 80. zlokalizowanego w Zielonej Górze.

The paper presents the effect of changes in the range of work provided in the project documentation, introduced during of the renovation work, on a date of ending and cost of the investment. Introduction of additional works, not included in the project, during repair work, requires from the investor and contractor flexibility, commitment and experience. The additional works are a significant obstacle in the investment process. Construction work not included in the project have a significant effect on the time and the total cost of the investment. This problem is exemplified by the renovation of the building, built in the '80s, located in Zielona Gora.

Roboty dodatkowe pojawiające się na etapie wykonawstwa robót są często występującym elementem w realizacji inwestycji budowlanych. Można je zdefiniować jako te roboty, których nie przewidziano na etapie sporządzania dokumentacji projektowej. Przyczyną ich wystąpienia mogą być: konieczność ich wykonania, gdy stają się niezbędne do realizacji zamówienia podstawowego, lub życzenie inwestora, który zdecydował się na wprowadzenie pewnych dodaktowych prac (np. rozszerzenie zakresu robót).

Additional works occurring at the completion stage of a construction process are a frequent element of construction investments. They can be defined as those works that have not been planned at the project documentation stage. The causes of their occurrence may be: the necessity of their completion when they are indispensable for the completion of the basic order or the demand of an investor who decided to introduce some additional works (e.g. the expansion of the work scope).
