Information is the good which reduces uncertainty and in the 20th century determines the stage of social development and territorial differentiation. Freedom of information and the right to information are fundamental elements of information society, while computerization is the catalyst for its development. The right to information is the standard in Europe. The essence of this right is defined in Poland by Article 61 of the Polish Constitution, according to which a citizen shall have the right to obtain information on the activities of public authorities as well as persons discharging public functions. Such a right shall also include access to information on the activities of self-governing economic or professional organs and other persons or organizational units relating to the field in which they perform the duties of public authorities and manage communal assets or property of the State Treasury. In particular, the right to obtain information includes access to documents. Moreover, according to Article 73 of the Constitution, every person has the right to information on the state and protection of the environment. The primary legal act which specifies constitutional norms is the Act on Access to Public Information dated 6 September 2001, although provisions of many different acts define other rules and procedures of access to information. An important factor in the development of information society is growing legislative clarity, revision of rules regulating functioning of the official source of information . the Public Information Bulletin (a system of websites), and the establishment of a coherent legal framework for the use of public sector information for commercial and non-commercial purposes.

Prezentowany artykuł jest pierwszym z cyklu mającego na celu analizę założeń i ocenę stopnia realizacji obowiązku dostępu społeczeństwa do informacji publicznej o środowisku. Prezentuje aspekty prawne związane z dostępem do informacji o środowisku, natomiast drugi artykuł będzie omawiał praktyczne aspekty realizacji tego obowiązku na przykładzie wybranego starostwa, miasta i gminy w województwie śląskim. Niniejszy artykuł jest próbą kompleksowego przedstawienia prawnych aspektów będących gwarancją swobodnego dostęp do informacji o środowisku. Przedstawiono akty prawne począwszy od Konstytucji, ogólnie precyzującej prawo dostępu do informacji, poprzez ustawę o dostępnie do informacji publicznej na ustawie prawo ochrony środowiska kończąc. Ponadto artykuł zawiera przykłady dostępu do informacji o środowisku oraz informacji o organach ją udostępniających poprzez sieć teleinformatyczną. Zamieszczone przykłady obejmują Biuletyn Informacji Publicznej oraz publicznie dostępny wykaz danych o dokumentach zawierających informacje o środowisku i jego ochronie - INFOOS, scharakteryzowane ze względu na ich budowę, sposób działania i stawiane przed nimi zadania. Opracowanie jest więc także próbą prezentacji nowej formy udostępniania informacji o środowisku tzn. umieszczania tematycznych baz danych oraz wykazów w sieci Internet.

The article initiates the series aimed at analyzing the assumptions and evaluating the realization of the obligation of the public access to public information on the environment. The first article discusses the legal aspects related to the access to environmental information, while the following article discusses the practical aspects of realizing this obligation on the example of a selected county (starostwo), city and a municipality in the Silesian Voievodeship. The article attempts also to present in a complex way the legal acts that guarantee free access to environmental information. The following legal acts have been considered: the Constitution that regulates access to information on a general level, act on the access to public information, and the environmental protection act. Moreover, the article includes examples of the access to environmental information alongside with information on the bodies that provide the access though Internet. The presented examples include: Public Information Bulletin and the publicly accessible data survey of documents containing environmental information and its protection - INFOOS. They have been characterized with respect to their structure, operation and tasks they are to meet. The study is also an attempt to present a new form of providing access to environmental information i.e. providing access to thematic databases and surveys via internet.
