Impact of occupational health and safety regulations on the employee's decision to take up employment

Workers' safety in the workplace depends on the compliance of both employees and the employer with applicable regulations. The EU member states in internal law contain regulations in line with EU directives in this area. The author of this study decided to examine whether compliance by the employer with health and safety provisions is an element motivating employees to take up employment. The law applies to both employees and employers, but their content is not affected by any of the parties to the employment relationship. The purpose of the article was to answer the question whether compliance by the employer with health and safety at work rules is an element that influences the employee when making a decision about taking up employment. The method used was the diagnostic survey method and the survey tool. The research was conducted in 102 facilities-enterprises in the Silesian Voivodeship employing at least 20 employees. The respondents were employees within the meaning of the Labor Code who declared knowledge of basic regulations in the field of occupational health and safety. The unambiguous lack of impact of compliance with the health and safety at work regulations by the employer on the decision on employment was indicated by 29.3% of respondents, while 60.8% of all respondents declared such an impact. Among the surveyed employees there was a group of undecided people.

W artykule przedstawiono w zarysie problematykę nowego zagrożenia w polskim górnictwie rud miedzi, jakim jest występowanie podwyższonych stężeń siarkowodoru i innych gazów siarkowych w wyrobiskach górniczych. W prezentowanym materiale zawarto ramy przepisów i metodykę postępowania na wybranych przykładach z górnictwa światowego oraz sposoby monitorowania i nadzorowania zagrożenia. Artykuł jest głosem przedstawiciela nadzoru górniczego w dyskusji dotyczącej możliwych kierunków formułowania przepisów wykonawczych dla zapewnienia bezpieczeństwa i higieny pracy przy prowadzeniu ruchu zakładów górniczych w specyficznym zagrożeniu, jakim jest występowanie siarkowodoru i gazów siarkowych.

Cases of increased hydrogen sulphide emanation and resultant incidents resulted in the appearance of numerous studies and analyses of this hazard. The article complements the subject in relation to necessary amendments to the regulations. It presents mining and safety regulations from selected countries. Taking into consideration the specificity of the copper ore mine ventilation structures, the article is also focused on the issues related to the methodology of measurements and their registration (including exposure of employees to hazards) and potential forms of monitoring of the hazard resulting from the properties of hydrogen sulphide.

Podejmowanie pracy przez Polaków za granicą jest obecnie na tyle powszechne, iż uzasadnione jest podjęcie tematu warunków pracy oraz funkcjonowania i organizacji BHP w przedsiębiorstwach Zachodniej Europy. W opracowaniu przedstawiono praktyczną realizację podstawowych działań z zakresu BHP w wybranym przedsiębiorstwie brytyjskim, posiadającym swoje oddziały w Norwegii i zatrudniającym głównie polskich pracowników. Omówiono podobieństwa i różnice w niektórych rozwiązaniach prawnych dotyczących ochrony pracy i na tej podstawie zaproponowano zmiany.

The commonness of taking up work abroad by Polish workers justifies discussing the working conditions and the management of Health and Safety at Work in companies of Western Europe. The paper presents the practical realization of the basic actions in the field of HSE in a selected British company. This company has its departments on the western coast of Norway and employs mainly workers from Poland. The similarities and differences in selected Health and Safety Regulations have been discussed and on their basis changes in Polish low have been proposed.
