The Inspire Directive introduces a conceptual framework related to spatial data infrastructure, unifying the issues related to the access to spatial data within the European Union. The Directive was implemented into Polish law in the Act of 4 March 2010 on spatial information infrastructure. Both the Directive and the Act provide for the possibility of introducing limitations to access to spatial data and services in connection if access would adversely affect, among others, intellectual property rights. The carried out study shows that most poviats subject to the study have not acquired the required scope of intellectual property which may potentially result in the access limitations.
Services related to the broadly understood spatial information are subject to constant and intensive digitization. In addition to many positive sides, such as broad access to services, digitization also brings negative phenomena such as cyber attacks, which have intensified in recent years. Responsibilities in the area of cybersecurity are subject to legal provisions, including the act on the national cybersecurity system. Unfortunately, these obligations are still not sufficiently fulfilled, which is reflected in the results of the Supreme Audit Office (NIK). Advice on safety measures can be found in the letter of the Surveyor General of Poland dated 24 February 2022. The measures indicated in the letter should be considered insufficient.
Geo-blocking are practices undertaken by sellers using technological means or otherwise, the result of which is to prevent, limit or differentiate the conditions of access to goods and services depending on the country or region of the customer’s origin. The Geo-blocking Regulation prohibits unjustified geo-blocking and other forms of discriminating practices based on the customers’ nationality, place of residence or place of establishment within the internal market. The Regulation covers three main types of practices: a) blocking or limiting access or automatically redirecting the user to another version of an online interface, b) applying different conditions of sale for the goods or services, and c) applying different payment conditions, based on the buyer’s location or nationality. The Regulation is to be applied in the Member States, and they took different approach to it . This paper aims to present the current legal framework as well as required changes to ensure it effectiveness and increase its impact on the internal market.
