Impact of legal protection on the preservation of a historical rural structure on the example of Frydman

This paper discusses the functioning of the heritage of the village of Frydman, which is one of the most wellpreserved cases of Spisz layouts and features numerous architectural monuments. The layout, which persists in local natural conditions, appears unthreatened despite the occurrence of significant change in the cultural landscape in historical architecture. The discussion begins with an identification of surviving elements of Frydman’s structure and an investigation of the determinants of its origins, which were sequentially referenced to contemporary times and possible development trajectories. The research objective of the study was to answer the problem of the functioning of heritage in present-day legal conditions, specifically in terms of heritage conservation and spatial planning. This study clearly indicates the complexity of the problem, in which the synergy of legal provisions and the local community is a crucial area. To ensure it, both a systemic improvement of the regulation and the raising of public awareness on heritage conservation and management would be necessary.

Artykuł dotyczy funkcjonowania dziedzictwa wsi Frydman, będącej jednym z najlepiej zachowanych przykładów układów spiskich, reprezentowanych przez liczne zabytki architektury. Trwające w uwarunkowaniach naturalnych, dziedzictwo to wydaje się niezagrożone podczas zmian krajobrazu kulturowego zachodzących w zabytkowej architekturze. Rozważania rozpoczyna zdefiniowanie zachowanych elementów struktury oraz uwarunkowań ich powstania, które kolejno zostają odniesione do czasów współczesnych i możliwych dróg rozwoju. Celem badawczym było znalezienie formy funkcjonowania dziedzictwa w ramach prawnych, m.in. z zakresu ochrony dziedzictwa oraz planowania przestrzennego. Badania jednoznacznie dowodzą złożoności problemu, w którym kluczowy jest wpływ realizacji zapisów prawa na życie lokalnej społeczności. W celu poprawy sytuacji konieczne są zarówno systemowa poprawa regulacji, jak i podniesienie świadomości społecznej na temat ochrony i zarządzania dziedzictwem.

Artykuł dotyczy problematyki lokalizacji i roli kościoła w historycznych strukturach wiejskich w powiązaniu z życiem społeczności. Na podstawie wybranych wsi polskiej części Zamagurza Spiskiego wskazano czynniki warunkujące główne przekształcenia struktur od czasu powstania do współczesności. Badany obszar, zróżnicowany krajobrazowo, był miejscem styku prądów kulturowych, religijnych oraz politycznych. W efekcie powstały odmienne morfologicznie układy, w których funkcjonowanie instytucji kościelnych, będąc każdorazowo wyrazem potrzeb religijnych społeczności, warunkowane było silnie przez specyfikę miejsca, w tym krajobraz.

This article deals with the problem of the place of the church in historical rural structures in connection with the life of the community. On the basis of selected villages of the Polish part of Zamagurze Spiskie, the factors determining the main transformations of structures from the time of their inception to the present day have been identified. The studied area, diversified in terms of landscape, was a meeting point of cultural, religious and political trends. As a result, morphologically different systems were created, in which the functioning of church institutions, each an expression of the religious needs of the community, was strongly conditioned by the specificity of the place, including the landscape.

Niniejszy artykuł prezentuje problematykę rozwoju obszaru wsi posiadającej dziedzictwo kulturowe objęte ochroną w formie Rezerwatu Ludowej Architektury, na przykładzie słowackiej wsi Osturnia. Analiza aktualnego stanu badanego obszaru została przeprowadzona pod kątem relacji zapisów obowiązującego, lokalnego planu zagospodarowania wobec regulacji, wynikających z ochrony konserwatorskiej. Swoje wnioski, obejmujące możliwe scenariusze rozwoju, autorki oparły na analizach sytuacji podobnych wsi słowackich, wspierając je tezami naukowymi z zakresu problematyki przemian obszarów wiejskich.

The article presents the subject matter of the development of the territory of a village that possesses cultural heritage that has been placed under conservation in the form of a Folk Architecture Preserve, on the example of the Slovakian village of Osturňa. An analysis of the current state of the investigated territory was performed, with a focus on the relationships between the provisions of the applicable local spatial development plan and the regulations that are applicable on account of conservation. The authors based their conclusions, which include possible development alternatives, on analyses of the situation of similar Slovakian villages, backing them up with academic theses from the field of the transformation of rural areas.
