The paper deals with the issue of different market access for the transport procurement in the EU in context of open market of providing forwarding services. It highlights different requirements of market access in freight forwarding. The article proposes conditions of market access unification in freight forwarding based on analysis of the existing situation. It also refers to the different responsibility of freight forwarder depending on membership in the national associations of freight forwarders. The contribution analyses the limitation of liability in freight forwarding and shows differences in contract of freight forwarding for particular shipments by model examples. There is also pointed to the need for the development of uniform freight forwarding conditions in the EU.

The price for the transport is determined by the carriers based on the costs incurred when the carriers transporting. Carriers are currently able to identify variable costs, the height of which changes with the change in the realized output and also fixed costs, which are dependent on the operating time of the means of transport. Carriers have the differences in the cost of the shipment for each destination they judge through the differences in charges for the use of the road network. It is also necessary to consider the possibility to backhaul transportation the vehicle for concrete transportation. The aim of this article is to verify the hypothesis, whether the change of the transport route is affected at the carrier's expense and in case, that is to quantify the impact of the transport route to the price for the transport carried out. We assume the effect of changing the shipping route also changes over time, therefore, the goal of the contribution is to identify changes the impact of the shipping route on the price within one week and to identify whether changes are developing in individual countries in the same process. Research is conducted on the basis of a situation survey in 19 European countries over a period of more than 3 months.

It is shown that if the operator N maps the space RV[phi]1 ([a, b]; K) into RW[phi]2([a, b]; CC[Y)) (both are spaces of functions of bounded [phi]- variation in the sense of Riesz), and if it is globally Lipschitz, then it has to be of the form H(t,u[t)) = A(t]u(t)+B(t), where A(t) is a linear continuous set-valued function and B is a set-valued function of bounded [phi]2-variation in the sense of Riesz. This generalizes results of G. Zawadzka [12], A. Smajdor and W. Smajdor [II], N. Merentes and K. Nikodem [5], and N. Merentes and S. Rivas [7].
