The author will discuss the bird strike phenomenon and its impact on the air transport of passengers. In addition to the above, examples of flying accidents mainly caused by bird strikes will be provided. Furthermore, the issue of responsibility for accidents caused by bird strikes will be discussed, alongside legal regulations pertaining to subjects connected with the topic.

Autorka w opracowaniu podjęła tematykę terroryzmu lotniczego i mechanizmów jego zwalczania. Przedmiotem rozważań jest pojęcie terroryzmu lotniczego oraz jego granic. Następnie, wyodrębnione zostaną międzynarodowe konwencje, które regulują niniejsze zagadnienie np. Konwencja o przestępstwach i niektórych innych czynach popełnionych na pokładzie statku powietrznego z 1963 r., Konwencja o zwalczaniu bezwładnego zawładnięcia statkami powietrznymi z 1970 r., czy Konwencja o zwalczaniu bezprawnych czynów skierowanych przeciwko bezpieczeństwu lotnictwa cywilnego z 1971 r. Ponadto, autorka przedstawi przykłady z orzecznictwa dotyczące terroryzmu lotniczego. Następnie, analizie poddany został wyrok polskiego oraz niemieckiego Trybunału Konstytucyjnego, który odrzuca możliwość zestrzelenia statku powietrznego, naruszającego przestrzeń powietrzną danego państwa. Szczególną uwagę autorka poświęciła kwestii dotyczącej mechanizmów służących utrzymaniu bezpieczeństwa przez państwa, linie lotnicze oraz port lotniczy. Prace wieńczą rozważania dotyczące bezpieczeństwa w ruchu lotniczym.

The author dealt with the subject of aviation terrorism and mechanisms aimed at combating it. The subject of discussion is the concept of aviation terrorism and its range. Then the author will discuss the international conventions that govern this issue, e.g. the Convention on Offences and Certain Other Acts Committed on Board Aircraft, the Convention for the Suppression of Unlawful Seizure of Aircraft of 1970 or the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation of 1971. The author will also present examples from the judicature concerning aviation terrorism. Subsequently, a ruling by the Polish and German Constitutional Tribunal which rejected the shooting of an aircraft violating the airspace of a given country will be analysed. A particular attention will be paid to the mechanisms aiming at securing the airlines and the airports by the state.The paper ends with deliberations on the air traffic safety.

The author of this article will discuss issues related to aircraft accidents. The paper will set out the investigative activities carried out by Poland’s State Commission on Aircraft Accidents Investigation. The author will also address the concept of liability for aircraft accidents. The paper will be concluded with comments on aviation accidents.
