Celem omawianego artykułu jest przedstawienie problematyki związanej z odpowiedzialnością prawną za szkody wyrządzone w środowisku oraz wykazanie różnic pomiędzy ich rodzajami.

The aim of the discussed article is to present the complexity of problems connected with legal liability for damages done in the environment as well as to show the differences between its types. The first part of the article takes the form of introduction and focuses on damages done to the environment and their causes. The starting point was the civil conception of the damage as described in Article 361 § 1 PCC. The next part concentrates on subjects responsible for damages to the environment, and finally, the problem of legal liability as specified by law of negative consequences and their improper application is discussed. Three types of liability have been discussed in detail, that is: administrative, civil and penal. Civil liability may occur in the form of compensation for damages done to the environment. We call it compensatory liability, or the one taking the form of omission of a certain activity, which expresses in preventive liability. This may be based on the principle of guilt as determined in Article 415 PCC or, on the basis of risk as outlined in Article 435 PCC. As it comes to administrative liability, the following have been characterized: pecuniary penalty, discontinuation or limitation of business activity and administrative compensation. The article also presents the most severe form of liability, that is, penal one. This is individual responsibility resulting from committing a crime or offence by an offender. The article finishes with synthetic conclusion.
