The aviation markets of European Union and the United States represent together approximately 60% of global aviation. The economic benefits associated with the implementation of the agreement are noticeable however it seems to be too early for making final summaries. Undoubtedly the potential economic benefits of removing the barriers to the EU - US transatlantic market are very significant and not to overvalue24. Open Skies agreement is an important development in the evolution of the global air transport industry. The open skies is very likely to result in great choice for travelers, lower fares and better levels of air service for many parts of Europe and United States. The comprehensive North Atlantic air transport agreement liberalizes the aviation market and brings it closer to trade and investment patterns in the broader US - EU relationship. It also provides significant advantages across the board for the air services sector, consumers, businesses who rely on express delivery services, commercial air travel and tourism.

Północno - Atlantycka umowa "Open Skies" zawarta między Unią Europejską a Stanami Zjednoczonymi jest istotnym krokiem w kierunku liberalizacji rynku lotniczego w tym regionie. Poprzez eliminację barier w dostępie do rynku, umowa przyczynia się do poprawy konkurencji na rynku lotniczym dzięki bliższej współpracy linii lotniczych, zawieraniu umów „joint venture", obniżeniu cen oraz zwiększeniu konkurencyjności. Artykuł opisuje tło procesu zawarcia umowy, jak również kluczowe korzyści z niej wynikające a także wpływ umowy na rynek lotniczy.

Współczesny obrót wierzytelnościami handlowymi dysponuje całą gamą instrumentów inkorporowanych do prawa wprost z praktyki życia gospodarczego. Celem opracowania jest analiza roli i efektywności głównych instrumentów prawnych służących restrukturyzacji wierzytelności w procesie zarządzania przedsiębiorstwem. W pierwszej części opracowania zostało omówione ekonomiczne i prawne ujęcie forfaitingu, a także przeprowadzono analizę porównawczą forfaitingu i faktoringu.

Today's receivables trade has a broad range of legal instruments incorporated directly from the practice of economic life. The purpose of this paper is to analyse the role and effectiveness of the main legal instruments for restructuring the debt in the process of business management. In the first part of the study the economic and legal aspect of forfaiting was discussed as well as the comparative analysis of forfeiting and factoring was carried out.

The article focuses on discussing the substance of the institution of leniency which is used against cartel agreements. The study was carried out with regard to the provisions of EU law and Polish law. The paper analyses the factors that determine the effectiveness of the leniency program. Some of the considerations were given to the practical effects of applying the scheme by the European Commission and the Office of Competition and Consumer Protection. The article discusses the issue of the impact of the leniency program on the effectiveness of antitrust proceedings and shows the factors which determine the effective functioning of the program.

Artykuł koncentruje się na przedstawieniu istoty instytucji leniency, stosowanej w zwalczaniu karteli. Omówienia tematu dokonano z uwzględnieniem przepisów prawa unijnego oraz polskiego. W artykule przeprowadzono analizę czynników, decydujących o skuteczności programu leniency. Część rozważań poświęcono efektom praktycznego stosowania programu przez Komisję Europejską oraz Urząd Ochrony Konkurencji i Konsumenta. Artykuł porusza problematykę wpływu stosowania instytucji leniency na skuteczność postępowań antymonopolowych oraz przybliża czynniki determinujące efektywne funkcjonowanie programu.
