Przedstawiono także refleksje i wnioski autora na temat miejsca i roli administracji publicznej w ochronie infrastruktury krytycznej, mające na celu poprawę jej ochrony.

The paper analyzes the essence of critical infrastructure protection, types of protection and the possibility of their implementation by the operators of such infrastructure. Also presents the author's reflections and conclusions about the place and role of government in the protection of critical infrastructure, to improve its protection.

The author has analysed legal legislatives that regulate security of the military infrastructure. Basing on it, he put forward the thesis that efficiency of operation of military administration in this range is unsuitable to contemporary threats of this infrastructure. And is also ineffective in protection of the infrastructure.

Autor poddał analizie akty prawne regulujące ochronę infrastruktury militarnej i na tej podstawie wysunął tezę, iż sprawność działania administracji wojskowej w tym obszarze jest nieadekwatna do współczesnych zagrożeń tej infrastruktury, podobnie jak skuteczność jej ochrony.

W artykule zostały omówione zagrożenia dla bezpieczeństwa kluczowych obiektów państwa, jakie generuje brak spójności w dziedzinie prawa regulującego ich ochronę i komunikacji międzyresortowej. Jak zauważa autor artykułu, w literaturze dotyczącej bezpieczeństwa państwa i jego kluczowej infrastruktury można znaleźć opis szeregu zagrożeń, brak wśród nich jednak tego zasadniczego, wynikającego ze złego stanowienia prawa w Polsce. Można je określić mianem „resortowego królestwa” w sferze bezpieczeństwa narodowego. Złe stanowienie prawa, jego inflacja oraz zła jakość to pierwsza z bolączek polskiej legislacji. Do tego dochodzi przekonanie rządzących, iż uchwalenie przepisów rozwiązuje problem. Wielość i rozproszenie instytucji zajmujących się oceną jakości projektowanych regulacji, działających niezależnie i nietworzących spójnego systemu, jest istotnym problemem wpływającym na jakość bezpieczeństwa państwa. Twórcy przepisów z reguły nie mają pełnego rozeznania potrzeby zmiany prawa, ani kompletnej oceny możliwych następstw. W efekcie zwracania uwagi na własne przepisy resortowe tworzą „resortowe królestwa” w ochronie kluczowej infrastruktury państwa, co zagraża sprawnemu funkcjonowaniu państwa w różnych stanach zagrożenia jego bezpieczeństwa.

The article discusses threats to safety of important state objects resulting from the lack of cohesion in law and ministerial communication, that regulate such objects’ protection. According to the author of article, in Polish literature on state security and security of its infrastructure there are many types of danger described, however, one of the most important is missing. It is the danger of erroneous law making and its influence on Poland’s security. This type of danger can be named “the danger of ministerial kingdoms”. Erroneous law making and inflation of law are the main mistakes of Polish legislative process. On the ministerial level it is often believed, that writing a law will solve all the evils. However, a large number and disjointing of institutions creating regulations, and autonomously evaluating them, are the main problems negatively influencing state security. Those who make the regulations don’t always have a full knowledge of the needs and possible outcomes of created directives. Looking only at their own ministerial fields they create the “ministerial kingdoms” and control separate units of country’s infrastructure. And this diminishes security of a country as a whole, and its infrastructure.
