Niniejszy artykuł przybliża problematykę budowy i eksploatacji kolei linowych w obszarze kompetencji organów i praw stron. Poprzez przekrojowe przeanalizowanie kluczowych regulacji wykazana zostaje rola postępowania administracyjnego, stanowiącego swoisty mianownik dla szeregu różnych regulacji z zakresu prawa materialnego. Autorki omawiają źródło kompetencji organów w procesie budowy i eksploatacji kolei linowych, a także reguły obowiązujące podczas ustalania tych kompetencji. Poddane analizie są także wynikające z procedury administracyjnej prawa stron, zarówno na etapie budowy kolei linowych, jak i w toku eksploatacji.

This paper brings up issues of construction and operation of transportation by rope in the area of competence of the authorities and the rights of parties. Through a complex analysis of key regulations the role of the administrative proceedings is indicated, which is specific kind of denominator for a number of different regulations in the field of substantive law. The authors discuss the source of the competence of the authorities in the process of construction and operation of transportation by rope, as well as the rules applicable in deter-mining these competencies. The rights of the parties arising from the administrative procedure are also analyzed, both during construction cableway and during operation.

Niniejszy artykuł przybliża problematykę dotyczącą zmian na gruncie kompetencji podmiotów publicznych, jakie muszą zostać wprowadzone do krajowego porządku prawnego z uwagi na konieczność implementacji Dyrektywy Parlamentu Europejskiego i Rady z 3 kwietnia 2014 r. w sprawie okresowych badań zdatności do ruchu drogowego pojazdów silnikowych i ich przyczep oraz uchylających dyrektywę 2009/40/WE. Autorki wyjaśniają czym w ogólności są kompetencje podmiotów publicznych, istotę inkorporowania aktu prawnego rangi europejskiej, a następnie omawiają zmiany, do których wdrożenia zobowiązany jest polski prawodawca w odniesieniu do podmiotów publicznych.

The article introduces the issue of modifications on the ground of the public subjects' competences, which have to be inserted into national legal order, due to the necessity of implementation the European Parliament and Council's Directive on periodic roadworthiness testes for motor vehicles and their trailers, and repealing Directive 2009/40/EC. The authors clarify what in general are the competences of the public subjects, the essence of the incorporation of European legal acts, and thereafter discuss the changes, which the polish legislator is committed to deploy with reference to the public subjects.

W niniejszym artykule omówiono kwestie związane ze stosowaniem przepisów karnych, uszeregowanych w Rozdziale 5 ustawy z dnia 21 grudnia 2000 r. o dozorze technicznym. Autorki wskazują niedoskonałości tych przepisów, a także ujawniają czynniki, które mogą mieć istotny wpływ na problemy jakie towarzyszą podczas ich procedowania organom władzy publicznej. W szczególności Prokuraturom i Sędziom. Artykuł zawiera również w związku z powyższym propozycje takich uregulowań prawnych, które skutecznie zminimalizowałyby naruszenia tych przepisów.

In the hereby article, there were discussed the issues of using criminal regulations marshaled in the Chapter 5th of the Law of 21 December 2000 on Technical Supervision. The authors lead the flaws of the regulations and divulgate the factors, which might have a significant impact on the problems associated with proceeding with them by the public authorities. Especially by Prosecutors and Judges. Therefore, the article includes the suggestions of the legal adjustments, which would effectively minimalize the violations of these regulations.

Niniejszy artkuł przybliża kwestie związane z egzaminowaniem kandydatów na diagnostów wykonujących badania techniczne pojazdów. Autorka wskazuje istotne zmiany, jakie wprowadziła do polskiego prawodawstwa nowelizacja ustawy o ułatwieniu dostępu do wykonywania niektórych zawodów regulowanych, która weszła w życie w dniu 10 sierpnia 2014 roku. Artykuł porusza kwestie związane z trudnościami, na które napotykają osoby przystępujące do egzaminu kwalifikacyjnego dla kandydatów na diagnostów. Autorka ujawnia jednocześnie czynniki, które mogą mieć na to istotny wpływ.

This article introduces issues related to the examination of candidates for diagnosticians performing technical inspections of vehicles. The author indicates the significant changes introduced to the Polish legislation by the amendment to the Act on facilitation of the access to perform certain regulated professions, which entered into force on August 10th, 2014. The article raises issues related to the difficulties faced by the persons taking the qualification examination for the candidates for diagnosticians. The Author also reveals the factors, that may have a significant impact on it.
