This paper is devoted to the Electricity Transmission System Operator (ETSO), since it plays a key role in the construction of a competitive EU energy market. It seems to be appropriate to look at the legal regulation of an ETSO in Poland - one of the larger EU Member States that is currently facing major network challenges. Current legal regulation of the Polish Electricity Transmission System Operator defies an unequivocal assessment. Although legal regulation of the Polish ETSO is not the worst, there is still a long way to go before the situation could be called optimal.

Opracowanie poświęcone jest operatorowi elektroenergetycznego system przesyłowego (EOSP), ze względu na kluczową rolę, którą odgrywa w budowie konkurencyjnego rynku energii UE. Ze względu na to, że Polska jest jednym z większych państw członkowskich UE o istotnych potrzebach w zakresie rozwoju infrastruktury sieciowej, analiza regulacji prawnej EOSP w Polsce wydaje się uzasadniona. Regulacja ta wymyka się jednoznacznej ocenie. Jakkolwiek regulacja prawna EOSP w Polsce nie jest fundamentalnie niewłaściwa, to jednak istniejącym rozwiązaniom daleko do optymalnych.
