FIDIC in view of Polish legal regulations

Abstrakty
The discussion concerning positive and negative aspects of FIDIC has been continuing in the infrastructure industry for quite some time now. Some of the addressed issues concerned its adjustment to Polish legal regulations and the possibility of using FIDIC as a sample contract for construction work. The popularity of using FIDIC contractual terms, as well as the possibility to modify them arbitrarily with specific terms, resulted in creating many various specimens. The analysis carried out for several dozens of terms of reference, concerning various tendering procedures for construction work, clearly demonstrated that each individual draft contract was different. The author of the article poses a very significant question, whether the use of FIDIC contractual terms is the only obstacle to prevent the smooth completion of contracts. The author also indicates that it is possible to introduce changes in legal regulations, which would help to eliminate misunderstandings when preparing contracts.
