Included in this article an analysis of chosen paragraph of the Act of collective public transport, in terms of their impact on the reduction of market failures regional bus indicates that it does not add signifi cant, new quality. Small opportunities are expected by the public carriers „tidying up” the passenger transport market and to eliminate or even reduce existing on the negative phenomena. The advantage of the Act is to bring together in a single act principles of functioning, organization, management and fi nancing of passenger transport. Unfortunately, this applies mainly to road transport, and in fact the bus transport. Other types of service are the numerous references to other legislation Assessment presented in this article may be controversial. The lively discussions during the training on the Act, however, confi rms that it has many weaknesses. Therefore it seems appropriate to continue the work on this piece of legislation aimed at the revision and amendments to those provisions which may be a threat for the development of passenger transport market. At this point it is worth recalling the thesis formulated by R. Tomanek that the problems of transport locate primarily in the real activity, rather than regulatory. You should also remember that the development of transport in Poland is the largest, where was the lowest level of regulation.
