Referat przedstawia rozwiązania w zakresie nadzoru runku wyrobów sprzedawanych za pośrednictwem transakcji internetowych (tzw. DMS) ograniczające zagrożenia związane z rosnącą popularnością e-handlu w Europie. Ukazano trendy branżowe w otoczeniu makroekonomicznym i rosnące ryzyko napływu na terytorium UE produktów niezgodnych z wymaganiami zasadniczymi dyrektyw unijnych. Dokonano prezentacji założeń unijnych systemów DMS i potencjalnych problemów natury formalnoprawnej ograniczających efektywność prowadzenia DMS w krajach UE/EFTA. Zawarto także skrótową prezentację systemów DMS funkcjonujących w Niemczech, Wielkiej Brytanii i w Polsce a także zwrócono uwagę na rolę wymiany informacji za pośrednictwem portalu CIRCA i systemu ICSMS.

The paper presents the solution for market surveillance of products being sold in online stores and on internet auction sites (allegro.pl, eBay.com). Section 1 contains an overview of the Polish and European market surveillance system. There are also discussed the main problems connected with growing popularity of online stores and auction sites. Section 2 is dedicated to the analysis of e-commerce in Europe and Poland. Cetelem Observer 2008 [5] report shows that in 2010 one-sixth of products will be sold online. Fig. 2 presents the products category and its popularity in online stores. Large part of these products have to be compliant with EMC and RTTE directives. Background of Desktop Market Surveillance (DMS) and its key elements are described in Section 3. The report of Project Team on Enforcement Issues [8] pointed at the main problems connected with DMS: legal aspects, inefficient information exchange, lack of dedicated tracking/ seeking software. DMS in Germany, the United Kingdom and Poland is briefly described in Subsections 3.1 - 3.3. It is noted that the agreements with eBay.de, eBay.co.uk and allegro.pl are the main key points of DMS in these countries. Section 4 emphasizes the role of administrative cooperation of EU/EFTA member states, usage of CIRCA server, ICSMS server and distribution of information amongst market surveillance authorities. The paper shows that only effective Desktop Market Surveillance can protect the European market against products not compliant with UE directives.
