Artykuł zawiera analizę przepisów prawa odnośnie własności złóż kopalin, uwzględniając regulacje zawarte w Kodeksie Cywilnym w zakresie własności nieruchomości gruntowej. Na tle tej analizy autor przedstawia niektóre propozycje nowych rozwiązań, zgłaszane w trakcie prac Sejmu RP nad projektem ustawy o zmianie ustawy - Prawo geologiczne i górnicze. Sformułowano polemiczne wnioski dotyczące tych propozycji.
