Przedstawione w artykule opinie będą dla wielu kontrowersyjne lub przynajmniej dyskusyjne. Są one jednak wynikiem obserwacji i bezpośredniego udziału w realizacji inwestycji drogowych według procedur FIDIC czy innych warunków umowy, które regulują stosunki pomiędzy inżynierem i wykonawcą. Na początku lat 90. XX w. rozpoczęły się kontrakty współfinansowane przez Bank Światowy i PHARE, w których brałem udział jako inżynier. Zajmuję się tą działalnością do dzisiaj. Wcześniej miałem możliwość pracy w krajach arabskich przy realizacji kontraktów drogowych na warunkach zbliżonych bądź identycznych z FIDIC. Stąd moja ocena przedmiotowych relacji jest wynikiem tych doświadczeń.

The opinions presented in this article may be quite controversial. They are, on the other hand, based on thorough observations and direct participation in road investment realizations compliant with FIDIC procedures or other terms and conditions of the contract, which regulate the relations between the Engineer and the Contractor. At the beginnings of the 90’s, contracts co-financed with the World Bank and PHARE were introduced and the Author had and still has the chance to take part in their realizations. In addition, he used to work in Arabic states and the terms and conditions binding there, were similar or almost identical with FIDIC. Therefore, the objective assessment has been made basing on the previous experience of the Author.
