Abstrakty

W pracy przedstawiono propozycję modelu katastru 3D dla Polski, na podstawie przeanalizowanych rozwiązań w zakresie katastrów trójwymiarowych stosowanych w różnych krajach na świecie. Rozprawa składa się z czterech zasadniczych części. W pierwszej zaprezentowane zostały wyniki analiz rejestracji w polskim katastrze nietypowych obiektów przestrzennych położonych na terenie miasta warszawy. Wobec braku katastru 3D w Polsce, a więc możliwości 9poza pewnymi wyjątkami) warstwowego ustanawiania prawa własności – w drugiej części pracy przeanalizowano obecne uregulowania prawne w zakresie możliwości realizacji inwestycji w przestrzeni „cudzej” działki katastralnej. Tym samym oceniono potrzeby w zakresie wprowadzenia katastru 3D w Polsce. W kolejnej części przeanalizowano aktualne zasady rejestracji obiektów 3D w katastrze w różnych krajach na świecie, jak również kierunki rozwoju dotychczasowych systemów katastralnych w kierunku katastrów 3D. Rozprawę kończy koncepcja modelowego ujęcia katastru 3D dla Polski. W modelu tym zaproponowano modyfikację postrzegania zasięgu prawa własności w ujęciu Kodeksu Cywilnego, która otworzy możliwość „warstwowego” ustanawiania tego prawa. Zaproponowana więc, obok dotychczasowej działki katastralnej, wprowadzenie do katastru nowych obiektów w postaci działek katastralnych 2D i 3D, które technicznie umożliwią realizację tego zadania. Określono szczegółowe uwarunkowania tworzenia działek katastralnych 2D i 3D, jak również zakres związanej z tym dokumentacji technicznej. Opracowano procedurę wydzielania działek katastralnych 3D na wniosek właściciela dotychczasowej działki katastralnej, jak również z urzędu, dla realizacji celów publicznych. Przedstawiono niezbędne zmiany związane z ustanawianiem odrębnej własności lokali w ujęciu katastru 3D.

The habilitation thesis presents a proposal of a 3D cadastre model for Poland, basing on analysed solutions in the field of three-dimensional cadastres applied in many countries. The thesis consists of four main sections. The first section presents result of analysis concerning registration in the Polish cadaster of various untypical spatial objects located within the city of Warsaw. Due to the lack of 3D cadastre in Poland, and therefore, the lack of establishment of property rights in vertical layers (apart from some exceptions) – the second section of the thesis presents the results of analysis of legal regulations existing in the field of possibilities to perform investments within the space of “somebody’s” property. Thus, demands in the field of introduction of 3D cadastre in Poland have been estimated. The next part of the thesis presents the thesis presents the analysis of current rules concerning registration of 3D objects in various countries, as well as directions of development of existing cadastral system towards 3D cadasters. The final part of the thesis presents the concept of the model approach to 3D cadastre for Poland. This model proposes modification of perception of the extension of ownership right as specified in the Civil Code, which would open the possibility to establish this right in “vertical layer”. Therefore – apart from the currently existing cadastral parcel – it has been proposed to introduce new objects in the form of 2D and 3D cadastral parcels, which would technically allow such a solution. Detailed conditions concerning creation of 2D and 3D cadastral, as well as the scope of related technical documentation, have been determined. The procedure to create 3D cadastral parcels, following the application of the owner of currently existing cadastral parcel, as well as ex officio procedures implemented to achieve public goals, have been developed. The required modifications related to establishment of separate property of premises according to the 3D cadastre approach have been presented.
