Artykuł jest poświęcony wybranym elementom procedury usunięcia pojazdu z drogi, opartej na przepisach art. 130a ustawy – Prawo o ruchu drogowym. Autor koncentruje uwagę na zagadnieniu wszczęcia tej procedury przez uprawnione podmioty oraz umieszczenia pojazdu na parkingu strzeżonym, wyznaczonym przez starostę. Omawia czynności, których wykonanie jest niezbędne do wydania takiego pojazdu z parkingu, a w przypadku nieodebrania pojazdu – wskazuje na obowiązki starosty związane z wystąpieniem do sądu z wnioskiem o orzeczenie przepadku pojazdu na rzecz powiatu. W sposób zamierzony nie uwzględnia tej części procedury, która odnosi się stricte do czynności związanych z wykonaniem orzeczenia o przepadku pojazdu nieodebranego w ustawowym terminie. Omawia zagadnienia bezpośrednio odnoszące się do postępowania z pojazdem kwalifikującym się do usunięcia z drogi, z umieszczeniem go na parkingu strzeżonym oraz z postępowaniem właściciela pojazdu zmierzającym do jego odebrania. Zwraca uwagę na pojęcie „usunięcie pojazdu z drogi” oraz na różnicę między tym pojęciem a pojęciem „umieszczenie pojazdu na parkingu strzeżonym” oraz na brak ustawowej definicji obu tych sformułowań.

The article is devoted to some elements of the procedure of removing a vehicle from the road, included in article 130a of the Law on Road Traffic. It is focused on the issue of the initiation of this procedure by authorised entities and placing the vehicle in a guarded car park designated by the district governor. The author also discusses the measures necessary for the delivery of the vehicle from the parking lot, and in the case of failure to collect the vehicle indicates the duties of the district governor to the to court for the confiscation of the vehicle for the benefit of the county. The procedure related strictly to the execution of the confiscation of the vehicle removed from the road and not collected within the statutory period is not discussed. This is because the aim of the article is a detailed discussion of the issues directly related to the procedure with vehicles qualified for the removal from the road by authorised entities, placing them in a guarded car park and measures that must be taken in this procedure by the vehicle owner or other authorised persons. Particular attention is paid to the concept of “removing the vehicle from the road”. The difference between this concept and the concept of “placing the vehicle in a guarded parking lot” is also highlighted as well as the lack of legal definition of both formulations.
