Abstrakty

Celem niniejszego artykułu jest przedstawienie pragmatycznych konsekwencji użycia pojęcia siła wyższa jako jednej z przesłanek zwalniających przewoźnika od odpowiedzialności za szkody powstałe w trakcie przewozu przesyłki. Pojęcie to nie ma swojej normatywnej definicji. Jego zakres wynika więc z nauki prawa i dorobku judykatury (orzecznictwa).

According to the Transport Law the liability of the carrier for lose and damage to the substance of goods and delay of delivery is based on risk. It indicates that this type of responsibility does not depend on the carrier’s fault. The carrier is free from such liability in case he has proven that the damage was caused by the act or neglect of sender or receiver, from inherent vice of goods or by the “force majeure”. The “force majeure” clause must be understood as an extraordinary event, external to an enterprise that cannot be averted even by using the greatest possible care. Avoidance of liability resulting from the force majeure is similar to the “circumstances which carrier could not avoid and the consequences of which he was unable to prevent”. Such clause was used in CMR. The most important difference is that the force majeure includes only matters external to the business operations of the carrier. Supreme Court of Poland exonerated the carrier from liability in the event of robbery by armed robbers treating this situation as circumstances which carrier could not avoid and the consequences of which he was unable to prevent. In the author’s opinion it is also possible to release the carrier from liability in this situation on the base of the force majeure, but in practice it would be very difficult to apply.
