Crisis situations : an attempt of parameterising
Crisis phenomena, which have been accompanying mankind since very early times, are always a complicated process that requires taking special activities. They are minor or major challenges that do not allow remaining indifferent. Obviously, these phenomena relate not only to single people but also larger communities, a whole country including. In such conditions, undertaking activities is extremely complicated because apart from the need to engage many different assets it requires also necessary legal regulations. The attempts to regulate the idea and definition of crisis situations in the Polish legal system were undertaken at the beginning of 2000. They resulted from the necessity to fulfil “a legal gap” between an ordinary state of the country’s functioning and states of emergency. The works were finalised in the middle of 2007 with passing the Bill on Crisis Management including, among others, the definition of a crisis situation. Unfortunately, the problem has not been completely solved. The accepted definition, far different from the one used in science, has raised many doubts from the very beginning. Finally the Bill on Crisis Management was appealed by the Democratic Left Alliance (SLD) to the Constitutional Tribunal. Thus there is a probability that the work on defining the crisis situations will be continued. The article features the course of creating the definition of crisis situation in the Polish system of law. Essential differences were indicated between a crisis situation and emergency situation in the state functioning. Also a general course of a crisis situation and presenting its characteristic moments are characterised.
