Purpose: The purpose of this paper is to identify the main challenges in the functioning of the Polish public procurement market, with particular emphasis on the use of environmental criteria in construction procurement. The paper aims to assess the extent to which the current regulatory framework supports sustainable development objectives through Green Public Procurement (GPP). Design/methodology/approach: The study employs a desk research approach combining a review of literature, legal analysis, and an examination of official statistical data from 20212023. It focuses on the practical application of selected provisions of the Public Procurement Law (PPL) that enable the incorporation of environmental aspects into the procurement of construction works. Findings: The analysis shows a gradual increase in the number and value of construction contracts with environmental elements. However, the share of GPP in the total number and value of public contracts remains low. Article 101 PPL, which requires a clear and precise description of the subject matter, is the most frequently used. Provisions such as Article 116 (environmental management systems), Article 242 (life-cycle costing), and Article 245 (non-price criteria) are rarely applied, indicating an underutilized potential to promote sustainability and innovation. Research limitations/implications: The study is limited to data from 2021 to 2023 due to inconsistencies in data classification in previous years. Further research is needed to explore the organizational, procedural, and institutional factors that influence GPP implementation. Practical implications: The findings point to the need for improved institutional support, training, and legal clarity to facilitate broader and more consistent use of environmental criteria in public procurement, particularly in the construction sector. Social implications: Greater use of GPP can help achieve environmental policy goals, promote sustainable construction practices, and positively influence public attitudes toward environmental responsibility. Originality/value: This paper provides one of the first comprehensive assessments of green procurement in Polish construction based on empirical data. It offers new insights for researchers, policymakers, and practitioners involved in sustainable public procurement.
This review paper explores circular economy (CE) initiatives and Green Public Procurement (GPP) practices in Poland, focusing on practical implementation and regulatory frameworks. The concept of CE is explored in depth, focusing on its potential to mitigate climate change and resource depletion by extending product lifecycles and reducing waste generation. Transitioning to a CE model offers numerous environmental and economic benefits, including decreased greenhouse gas emissions, enhanced resource efficiency, and job creation. The transition to a circular economy aligns with sustainable development goals. GPP drives demand for eco-friendly products and services, evolving to include environmental and social considerations. The Sztum Circular Economy (SCE) project, funded under the “Environment, Energy, and Climate Change” program, serves as a case study to illustrate the practical application of CE principles locally through initiatives like selective waste collection and educational campaigns. This review highlights the synergy between CE and GPP, offering guidance for policymakers, municipalities, and stakeholders seeking to advance sustainability agendas at the local and national levels. By embracing CE and GPP, countries can accelerate the transition to sustainability while addressing environmental and social challenges.
Purpose: Governments in many countries are trying to prevent climate change. One way of doing this is through green public procurement that consists of procuring goods, services and works with a reduced environmental impact during their life cycle compared to goods, services and works with an identical purpose that might otherwise have been procured. So the paper aims to examine private companies’ readiness to provide green goods and services in response to demands of green public procurement. This may encourage public entities to wider use of green public procurement because they may be afraid of an inadequate amount of companies that can meet the procurement criteria. The paper provides tips on how to organize the work of a public institution to make green public procurement more widespread. Design/methodology/approach: The methods used in this study were literature analysis, statistical survey, static analysis and case study. By means of a statistical survey and analysis, the relationship between the knowledge of employees of a given company regarding the knowledge of concepts related to green public procurement and the type of position was demonstrated. On the other hand, with the help of a case study, it was shown how an existing public procurement can easily be transformed into a green public procurement. Findings: In order to achieve sustainable outcomes, it is necessary to introduce internal regulations of public organisations relating to the integration of environmental considerations into tendering procedures. Public organisations should realise how easy it is to turn a public procurement into a green public procurement and that companies are already ready to do it. Almost any company can meet the environmental requirements to participate in green public procurement, the criteria depend on the ingenuity of the public organisations' staff. The main difficulties in including environmental aspects in tendering procedures include insufficient knowledge and experience of the contracting authorities in their practical application. Originality/value: The paper discusses the role of green public procurement, as well as how to manage a public organisation, what to do to make green public procurement widely used. Relevant knowledge of public employees, political will, as well as the fashion for green public procurement are important in the introduction of the above mentioned procurement. The paper also focuses on the private company's point of view.
W artykule przedstawiono znaczenie zielonych zamówień publicznych zgodnie z nowymi wytycznymi Unii Europejskiej dla inwestycji budowlanych i transportu drogowego jako obszarów priorytetowych. Zwrócono uwagę na nowe wymagania zgodne z wytycznymi Komisji Europejskiej dotyczącymi aspektów prawnych zielonych zamówień publicznych oraz przedstawiono kryteria środowiskowe w cyklu życia budynków oraz pojazdów dla zielonych zamówień publicznych. Wskazano również na główne inicjatywy, które należy podejmować w obszarach budownictwa i transportu w kierunku spełnienia kryteriów zielonych zamówień publicznych.

The article presents the importance of green public procurement in accordance with the European Union new guidelines for construction investments and road transport as priority areas. Attention was drawn to new requirements in line with the European Commission guidelines on the legal aspects of green public procurement and environmental criteria in the life cycle of buildings and vehicles for green public procurement were presented. The main initiatives that should be taken in the areas of construction and transport to meet the criteria of green public procurement were also indicated.

The aim of the article is to show how one of the most active and demonstrative management tool for furthering sustainable development can be successfully implemented through a Central and Eastern European example. The Green Procurement Hungary Project (GPH project) was conducted in order to develop a toolkit most suitable for implementing green (public) procurement, in order to use the enormous purchasing power of public and private organizations for furthering sustainable consumption, eco-production and all together sustainable development. The article shows the relationship between sustainable-, green- and social procurement, introduces the state-of-the art of green public procurement in the EU with specific attention to the CEE countries and shows the methodology developed in the GPH project. This methodology has great significance for practitioners and policy makers as well for the implementation of sustainable procurement. Even on the European level, for example by the development of funding opportunities and by the evaluation of project proposals these experiences are valuable.

Projekt węgierskich zielonych zamówień (The Green Procurement Hungary Project, GPH project) wprowadzono, aby poszukiwać najlepszych rozwiązań w tym zakresie. Celem jest wykorzystanie ogromnej mocy nabywczej firm publicznych i prywatnych dla wspierania zrównoważonej konsumpcji i eko-produkcji, a poprzez to zrównoważonego rozwoju. Artykuł ukazuje powiązania pomiędzy zrównoważonymi, zielonymi i społecznymi zamówieniami, wskazuje na najnowsze rozwiązania przyjęte w UE, szczególny nacisk kładąc na kraje Europy Wschodniej, omawia także ich stronę metodologiczną. Ten ostatni aspekt jest niezwykle istotny dla praktyków i polityków, jak również w kontekście bezpośredniego wdrażania zielonych zamówień. Nawet na ogólnoeuropejskim poziomie, przykładowo poprzez rozwój instrumentów finansowych, czy sposobów oceny zgłaszanych wniosków, te doświadczenia są bez wątpienia wartościowe.
W artykule przedstawiono aktualnie obowiązujące przepisy dotyczące przyznawania oznakowania ekologicznego UE (tzw. EU Ecolabel) dla grupy wyrobów smary. Opisano przyszłe zmiany wynikające z wydłużenia okresu obowiązywania kryteriów ekologicznych dla powyższej grupy wyrobów, z wejścia w życie klasyfikacji substancji i mieszanin według rozporządzenia CLP, jak również z wdrożenia przepisów dyrektywy w sprawie zamówień publicznych.

The paper presents current regulations of awarding an EU Ecolabel for lubricants and future changes resulting in process of prolonging the validity of criteria for this group of products, entering into force of new classification of substances and mixtures according to CLP Regulation as well as entering into force of new Directives on Green Public Procurement. The author compares those ecological criteria with EU Ecolabel criteria in respect of application areas and presents advantages of using lubricants with EU Ecolabel.

The paper assesses the progress of the implementation of the Integrated Product Policy in European Union. It presents the main elements of the IPP: LCA, ecolabeling, EMAS, green public procurement, ecotaxes and corporate social responsibility. It contains a study on the perception of the ecological factor identification as a criterion of consumer choices. It has also shown the level of the ability of identification products which has better environmental parameters, among Polish, Belgian and German consumers.

It assesses the progress of LCA implementation, ecolabelling, ecotaxes, EMAS and green public procurement in Poland. It explains the reasons of slow IPP implementation in Polish organisations.
