Besides presenting the current literature, attempts at regulation, and practice concerning anthropogenic deposits, the paper outlines the history of applying the Geological and Mining Law to them, along with its legislative changes. The author discusses both the legal provisions and their application in practice from 80 years ago, as well as current proposals, which constitute a rich body of work providing many interesting considerations and solutions. However, it is suggested that, in order to avoid inefficiency and chaos, there must be compatibility between regulations and solutions derived from science and practice in fields such as geology and mining, energy, environmental protection, waste management, water management, raw material strategy in the economy, and spatial planning. When considering the issues of anthropogenic deposits, the paper takes the following initial assumptions into account: The common and naturally diverse occurrence of mining waste and waste from the processing of mineral raw materials has long justified the need to introduce regulations for their exploration and exploitation. The wide variability and inaccuracy in attempts to practically define anthropogenic deposits require a new statutory definition, distinguishing mining waste from the processes of treating/beneficating the excavated mineral (or mine output) and differentiating it from waste resulting from raw material processing and market production. It is also required to differentiate historical secondary deposits (landfills from previous centuries, tailings piles/waste dumps, and certain rock raw materials not classified as useful minerals, which are today partially considered sources of critical raw materials). Prior to the inventory of prognostic accumulations of mineral waste, it is necessary to adopt regulations concerning their classification, identification, and exploitation.

The extractive industry is a significant source of waste in Poland. Legal provisions of dealing with waste from the exploration, extraction and processing of minerals, due to their specificity, are regulated separately in the Mining Waste Act. Only in unregulated matters the provisions of the Waste Act are to apply. It should be noted, however, that the legislation regarding waste do not apply to: - extractive residues, if the concession for the extraction of minerals or the mining plant operation plan, or the local spatial development plan for the mining area specify the conditions and manner of their development, - overburden, dumped in a mining area, if the term and method of its management have been determined in accordance with the provisions of the Geological and Mining Law regarding the operation of a mining plant, unless it constitutes waste within the meaning of the provisions of the Waste Act. In accordance with the waste hierarchy referred to in this article, waste generation should be prevented as a priority. A significant part of extractive residues is managed in accordance with the above mentioned requirements, including, inter alia, placing it back into excavation voids for reclamation purposes. Data presented in the article indicate that the amount of extracted residues in 2021 in the mining plants covered by the statistics counted 346.3 million tonnes, of which only 67.6 million tonnes (19.5%) were mining waste, while as much as 278.7 million tonnes (80.5%) are not subject to waste regulations.

Analizy zostały wykonane w różnych latach aktywności wyrobisk ((Klojzy-Karczmarczyk i in. 2016a; Klojzy-Karczmarczyk i Staszczak 2017, 2019; Staszczak 2020).

The open-cast workings filling with extractive waste is possible in the process of technical reclamation, but it requires a detailed recognition of environmental conditions. The use of various types of waste to fill the workings is a complex issue, in the field of the waste material quality and in the field of determining locations assigned for such waste management. It is important to recognise the location of active opencast mines against a background of main groundwater basins (MGB) and close to watercourses. The workings, left after extraction of carbonate raw materials, as well as sands and gravels, were analysed. The analysis were performed in different years of the open pits activity (Klojzy-Karczmarczyk et al. 2016a; Klojzy-Karczmarczyk and Staszczak 2017, 2019; Staszczak 2020). In the carbonate raw materials group (crushed and block stone) only 3 facilities are situated outside the MGB area and at a distance of more than 500 m from surface watercourses. In the sands and gravels group only 19 facilities are situated outside the MGB area and at a distance of more than 500 m from surface watercourses. Total mercury content and the amount of its leaching was compiled. The percentage of leachable form in the total content of the element was studied. The studies were carried out under various pH conditions of the environment. The analysis was based on the studies from 2014–2021 (Klojzy-Karczmarczyk and Mazurek 2014, 2019a, b, 2021). The extractive waste of the barren rock type (aggregate) features a higher content of total mercury in the finest fraction and a lower in coarser fractions. The share of mercury leachable form on average is 1.3–2.0%. The share of mercury leachable from coal sludge is approx. 1.8%. At pH reduction this share increases in each case. A clear increase in leachability is observed in the weathered waste. Because of the waste material quality, the studies on extractive waste have shown a possibility to use it for reclamation.

Hard coal mines overseen by the District Mining Authority in Rybnik strive to minimize their impact on the environment. Mine water is used, among others, for fire prevention (sealing abandoned works, liquidating pits using water and ash mixtures), for process purposes(e.g. sprinkling the output, cooling machinery, refilling the closed Circuit of the processing facility). If possible, mines source water from their own underground intakes, or use treated rainwater and snowmelt. In turn, mining waste is managed on the surface, used for creating reclamation and landscape forms, and to fill the sedimentation tanks for flotation waste, mining pits, reservoirs, etc. A part of the waste is used for producing aggregates and for filling pits as part of fire prevention. As part of mining activities, a part of the land requires reclamation through: development of land form, improvement of soil properties and soil recovery, regulation of water conditions, reinforcement of scarps, and reconstruction and construction of the necessary roads. The experience of underground mining plants has shown that selective management of mine water will allow for reusing even the most saline water and Iowering the environment use fees. Another important aspect is fire prevention at the bottom of mines, as it allows for the reuse of burdensome waste and saline water. The "Olza" reservoir plays an important role in the management of mine water, as it contributes to the conservation of River Odra. With reference to the reclamation of mine areas, it was shown that soil-free reclamation methods successfully eliminate topsoil shortages.

Sixteen samples were designed for analysis (hard coal, aggregate – barren rock, hard coal sludge). The total mercury content and the amount of mercury leaching were determined. The percentage of leachable form in the total content was calculated. The studies were carried out under various pH medium. The leachability under conditions close to neutral was determined in accordance with the PN EN 12457/1-4 standard. The leachability under acidic medium (pH of the solution – approx. 3) was determined in accordance with principles of the TCLP method. The mercury content was determined by means of the AAS method. For hard coal the total mercury content was 0.0384–0.1049 mg/kg. The level of leaching on mean was 2.6%. At the acidic medium the amount of leaching increases to an mean 4.1%. The extractive waste of aggregate type features a higher total mercury content in the finest fraction < 6 mm (up to 0.4564 mg/kg) and a lower content in the fraction 80–120 mm (up to 0.1006 mg/kg). The aggregate shows the percentage of the leachable form on mean from 1.4 to 2.2%. With pH decreasing to approx. 3, the amount of leaching grows up to mean values of 1.7–3.2%. Coal sludge features the total mercury content of 0.1368–0.2178 mg/kg. The percentage of mercury leachable form is approx. 1.8%. With pH decreasing the value increases to mean value of 3.0%. In general, the leachability of mercury from hard coals and extractive waste is low, and the leachability in an acidic medium grows approx. twice. Such factors as the type and origin of samples, their grain composition, and the pH conditions, have basic importance for the process. The time of waste seasoning and its weathering processes have the greatest impact on increasing the leaching of mercury from the extractive waste.

Do analizy przeznaczono 16 próbek (węgiel kamienny, kruszywa – skała płonna, muły węgla kamiennego). Odpady wydobywcze typu kruszywa charakteryzują się wyższą zawartością rtęci całkowitej we frakcji najdrobniejszej < 6 mm (do 0,4564 mg/kg) i niższą we frakcji 80–120 mm (do 0,1006 mg/kg).

A systematic increase in the demand for mineral raw materials combined with the difficulty of obtaining them from primary sources, made it necessary to use secondary ones including mineral waste. The effectiveness of the management of mineral waste stored in landfills and from current production depends on many factors. The most important ones include the legal regulations of this activity and the technical and organizational determinants of deposit exploitation, processing, and refining of minerals. The paper analyzes the current waste (including mining waste) management regulations. The technological discrepancies in these regulations, as well as missing or inaccurate classifications, were demonstrated. The interchangeable use of notions: mining/mine and extractive/extraction is a primary source of problems. It also has to be noted that accompanying and joint minerals are not defined in appropriate legislation. Attention was also paid to the omission of important issues in these regulations, e.g. product structure, construction of anthropogenic deposits, etc. It was emphasized and demonstrated with examples that the comprehensive and rational exploitation of mineral deposits, combined with processing and refining of mineral raw materials is an effective way of using mineral waste. The obtained results allowed for formulating proposals regarding legal provisions regulating waste management and the recommendation of technical and organizational solutions for the activities of mining, processing, and refining of mineral raw materials.

W podsumowaniu sformułowano propozycje i postulaty dotyczące przepisów prawnych regulujących gospodarkę odpadami, a także upowszechnienie rozwiązań techniczno-organizacyjnych procesów wydobycia, przeróbki i przetwórstwa surowców mineralnych.

The publication analyses and evaluates the impact of the implementation of circular economy on the economy and especially on its mining and power generation sector in Poland. Circular economy is a relatively new concept concerning an innovative economic development model. The publication briefly describes the concept of circular economy. Among other things, the basic economic processes that make up circular economy are discussed. In addition, history is presented as well as examples of legislation that have had the strongest impact on the implementation of circular economy in the EU are identified. Further on in the paper, the impact that circular economy will have on the mining and power generation industry in Poland is discussed. Areas have been identified that will need the most attention in relation to the implementation of circular economy. It was pointed out that in the mining and power generation sector the scale of use of current and landfill waste should be increased as a priority. Attention has been paid to the necessary reduction of water demand and rational water and sewage management. Examples of use of mining gas and ventilation air have been discussed. The publication provides examples of a number of measures taken in accordance with circular economy. It was pointed out that there is still a need to popularize the existing ones and to look for new technical and organizational solutions conducive to the introduction of this new economic model. An important aspect of the impact of the circular economy on these sectors will be the decrease in energy demand resulting from the widespread implementation of the new economic model. For those already struggling with a number of problems of some of the mining and power generation sectors based on coal mining and combustion in Poland, the implementation of circular economy will pose another challenge.

Aktualnie realizowana jest nadbudowa OUOW Żelazny Most do rzędnej 195 m n.p.m. W artykule przedstawiono aktualny stan rozbudowy OUOW Żelazny Most, a także wybór technologii deponowania odpadów. Opisano ewolucję obiektu, a w szczególności - postrzegania problemu zapewnienia najwyższego poziomu niezawodności obiektu i bezpieczeństwa terenów przyległych. Jednocześnie wskazano OUOW Żelazny Most jako przykład obiektu hydrotechnicznego, przy którym do eksploatacji i projektowania dalszej rozbudowy wykorzystuje się wyniki monitoringu.

A necessary condition for the KGHM PM S.A. operation is tailings management. Tailings are mineral waste and their chemical composition does not influence significantly the environment. Currently, disposal is carried out in the Mining Waste Treatment Facility (OUOW) Żelazny Most. The construction of the facility began in 1974, and its operation and expansion has been ongoing continuously since 1977. Currently OUOW Żelazny Most is being extended to the elevation 195 m a.s.l.
