Samowola budowlana jako przyczyna katastrof budowlanych

Celem artykułu jest przedstawienie terminu samowoli budowlanej w świetle obowiązujących przepisów prawnych oraz oszacowanie skali jej udziału wśród przyczyn katastrof budowlanych w Polsce na podstawie dostępnych danych statystycznych. W pracy zawarto opis terminu katastrofy budowlanej oraz statystyki zawarte w dostępnych opracowaniach oraz raportach GUNB. Z uwagi na brak dotychczasowego ujęcia samowoli jako odrębnej przyczyny zniszczeń we wspomnianych raportach, analizę oparto o informacje o typach budynków najczęściej ulegających zawaleniu w latach 1995-2015 oraz statystyki rozbiórek obiektów budowlanych w latach 2004-2023. Dzięki temu możliwe było oszacowanie występowania zjawiska samowoli budowlanej i jej potencjalnego wpływu na katastrofy budowlane. W artykule zawarto także przegląd najbardziej interesujących tego typu zdarzeń na świecie i w Polsce.

The aim of the paper is to present the term of building unauthorised construction in the eyes of the law and to estimate the scale of its contribution among the causes of building disasters in Poland on the basis of available statistical data. The paper includes a description of the term construction disaster and the statistics included in available studies and GUNB reports. Due to the lack of previous coverage of unauthorised construction as a separate cause of damage in the aforementioned reports, the analysis was based on information about the types of most frequently collapsing buildings in 1995-2015 and statistics of demolitions of buildings in 2004-2023. This made it possible to estimate the incidence of unauthorized construction and its potential impact on construction disasters. The article also reviews selected incidents of this type in the world and in Poland.

Unauthorized construction is a social phenomenon, the occurrence of which depends on legal conditions. The regulation of construction, on the one hand, ensures public safety, on the other - violates the freedom of individuals. The conflict of values is particularly evident in the case of construction on one’s own plot, which does not pose a threat to other entities. The purpose of the article is to identify the determinants of the occurrence of unauthorized construction. They may result from imperfections in the functioning of the legal system (at the level of its creation or application). In this part of the work we will address the inflation of the law, the low quality of legal regulations, their frequent change and the attitude of the authorities to the norms of the law. In Part 2, we will discuss the extra-legal background of unauthorized construction - social, historical, economic, political. Determining the genesis of unauthorized construction can be an important guideline for the development of construction law.

W artykule przedstawiono opis usterek stropu, które powstały jako następstwo jego samowolnej przebudowy przeprowadzonej bez dokumentacji remontowej oraz z pominięciem zasad wiedzy technicznej. Strop pierwotnie pełniący funkcje stropodachu został przebudowany w zakresie zmiany jego konstrukcji oraz warstw wykończeniowych, a uzyskana powierzchnia była użytkowana jako taras widokowy. W pracy przedstawiono propozycję naprawy polegającej na przywróceniu pierwotnej funkcji stropodachu.

In the paper, a description of defects of the floor, which appeared as the result of its arbitrary reconstruction, performed without arenovation documentation and with omitting rules of technical knowledge was presented. The floor, originally fulfilling functions of the flat roof, was reconstructed in the structure and finishing layers, with recived areas being used as an observation terrace. In the following work, a proposition, consisting the reconstruction of the structure of the flat roof was presented.
