Przedstawiony artykuł podejmuje problematykę dotyczącą możliwości wydzielenia działki budowlanej zabudowanej budynkiem mieszkalnym, niezależnie od ustaleń określonych w planie miejscowym a w przypadku jego braku od decyzji o warunkach zabudowy i zagospodarowania terenu, na zasadach określonych w art. 95 pkt 7 ustawy o gospodarce nieruchomościami. Uwzględniając specyfikę tej normy prawa o charakterze lex specialis wskazano, po zaistnieniu jakich ustawowych przesłanek wynikających z przyjętego ratio legis tej regulacji, podział taki może być dokonany.

The presented article addresses issues related to the possibility of separating a building plot developed with a residential building independently of the provisions set out in a local spatial development plan, and in case of the absence of such a plan—independently of a decision on development conditions and land use. Such separation is considered under the rules specified in Article 95(7) of the Act on Real Estate Management. Taking into account the specific nature of this legal norm as a lex specialis, the article indicates the statutory prerequisites—stemming from the adopted ratio legis of this regulation—under which such a subdivision may be carried out.

Artykuł rekonstruuje normę prawną określającą zakres treści mapy z projektem podziału nieruchomości, koncentrując się na zwrotach nieostrych „niezbędne” i „istotne”. Wykazano, że obowiązek ujmowania elementów zagospodarowania terenu nie ma charakteru automatycznego, lecz wymaga selekcji według relewancji dla celu podziału oraz ryzyka błędu decyzyjnego. Rozróżniono też „umieszczenie elementu na mapie” i „pozyskanie danych” (zasób vs pomiar), wskazując, że pomiar uzupełniający jest dopuszczalny, gdy jest konieczny dla prawidłowej treści mapy w zakresie elementów relewantnych.

The article reconstructs the legal norm defining the required content of a subdivision plan map, focusing on the vague terms “necessary” and “significant”. It shows that depicting land-development elements is not automatic but requires selection based on relevance to the subdivision purpose and the risk of decision-making error. The paper also distinguishes “depicting an element on the map” from “data acquisition” (resources vs measurement), arguing that supplementary (updating) measurements are permissible when necessary to ensure the map’s correctness within the scope of relevant elements.

W artykule omówione zostały kluczowe wymogi planistyczno-geodezyjne, od których uzależniona jest dopuszczalność podziału nieruchomości na gruncie ustawy o gospodarce nieruchomościami. Artykuł koncentruje się na dwóch fundamentalnych przesłankach: zapewnieniu dostępu do drogi publicznej oraz zgodności projektu podziału z miejscowym planem zagospodarowania przestrzennego (MPZP) lub, w przypadku jego braku, z decyzją o warunkach zabudowy i zagospodarowania terenu. Wskazano hierarchię form dostępu do drogi publicznej (bezpośredni, poprzez drogę wewnętrzną, w drodze służebności), a także skutki braku takiego dostępu w postaci odmowy zatwierdzenia projektu lub zawieszenia postępowania. W części dotyczącej zgodności z MPZP omówiono znaczenie ustaleń planu miejscowego w kontekście podziału nieruchomości oraz przywołano orzecznictwo Naczelnego Sądu Administracyjnego potwierdzające konieczność respektowania wymogów planistycznych, w tym parametrów technicznych działek. Wskazano również wyjątki przewidziane w art. 95 GospNierU, pozwalające na dokonanie podziału niezależnie od ustaleń planu. Artykuł zawiera także analizę roli decyzji o warunkach zabudowy jako podstawy oceny dopuszczalności podziału w sytuacji braku planu miejscowego. W podsumowaniu podkreślono praktyczne znaczenie omawianych regulacji dla ochrony ładu przestrzennego i bezpieczeństwa obrotu nieruchomościami. The article discusses the key planning and geodetic requirements that determine the admissibility of land subdivision under the Real Estate Management Act. It focuses on two fundamental prerequisites: ensuring access to a public road and compliance of the subdivision project with the local spatial development plan (MPZP) or, in its absence, with a zoning decision (decision on land development and use conditions). The hierarchy of forms of access to a public road (direct access, via an internal road, or through an easement) is presented, as well as the consequences of lacking such access, which may result in refusal to approve the subdivision or suspension of the administrative proceedings. In the part concerning compliance with the local plan, the article discusses the significance of the plan’s provisions in the context of land subdivision and cites the case law of the Supreme Administrative Court, which confirms the need to respect planning requirements, including the technical parameters of plots. It also refers to the exceptions provided in Article 95 of the Real Estate Management Act, which allow subdivision regardless of the local plan’s provisions. The article further analyses the role of the zoning decision as the basis for assessing the admissibility of subdivision in the absence of a local plan. In conclusion, the paper emphasizes the practical importance of these regulations for maintaining spatial order and ensuring the legal security of real estate transactions. Compliance with planning and geodetic requirements is a condition for the effective implementation of subdivision, while their violation results in refusal to approve the project or invalidation of the administrative decision.

W artykule omówiono kluczowe aspekty prawne związane z podziałem nieruchomości, szczególnie w kontekście współwłasności łącznej, majątku wspólnego małżonków oraz majątku wspólników spółek cywilnych. Przedstawiono różne formy podziału, takie jak podział geodezyjny, prawny i wieczystoksięgowy, które umożliwiają dostosowanie procedur do specyficznych potrzeb właścicieli. Zwrócono uwagę na złożoność współwłasności łącznej, która wymaga zgody wszystkich współwłaścicieli na zarządzanie majątkiem, co zabezpiecza jego integralność do momentu zakończenia wspólności. The complexity of joint co-ownership is highlighted, as it requires the consent of all co-owners for property management, ensuring the integrity of the assets until the co-ownership is dissolved. The article also examines division procedures following the termination of co-ownership, alongside the significance of marital agreements and selected court rulings, providing practical insights into the topic. In the article, it is emphasized that proper preparation and adherence to legal regulations are crucial for successful investments and the protection of co-owners' interests.

Inspiracją do pochylenia się nad tematyką podziału nieruchomości jest chęć przeanalizowania obecnie obowiązujących, jak i uchylonych aktów prawnych w kontekście przyjęcia granic nieruchomości dzielonej oraz wychwycenie niespójnych, problematycznych uregulowań. W obecnym stanie prawnym wiele kwestii dotyczących przyjęcia granic nieruchomości dzielonej nie zostało doprecyzowane lub interpretacja poszczególnych zapisów nie jest jednoznaczna. Część przepisów może budzić również kontrowersje, ponieważ ich literalna wykładnia prowadzi do wniosków, że są to zapisy niespójne i nielogiczne. Skutkuje to powstawaniem licznych komplikacji na etapie kompletowania prac związanych z podziałem nieruchomości, uzależniając wiele kwestii od indywidualnej interpretacji wykonawcy prac geodezyjnych. Odbyty staż w Małopolskiej Wojewódzkiej Inspekcji Geodezyjnej i Kartograficznej, realizowany w ramach współpracy z Wydziałem Geodezji Górniczej i Inżynierii Środowiska Akademii Górniczo-Hutniczej w Krakowie, przyczynił się do opracowania pracy magisterskiej, w zakresie przywołanej problematyki. Istotnym elementem pracy była analiza operatów geodezyjnych, będących przedmiotem weryfikacji Małopolskiego WINGiK-a. Jednak ze względu na ograniczoną jawność pozyskanych materiałów, w niniejszym artykule nie przedstawiono szczegółów tej części badawczej pracy dyplomowej, a jedynie wyciągnięte wnioski. W artykule odniesiono się zarówno do problematycznych kwestii formalnych, praktycznych uwag związanych z przyjęciem granic, jak i propozycji doprecyzowania aktualnie obowiązujących przepisów prawa.

The inspiration to delve into the topic of property division stems from the desire to analyze currently applicable, as well as repealed legal acts, in the context of boundary acceptance of divided property and to identify inconsistent, problematic regulations. In the current legal framework, many issues regarding the boundary acceptance of divided property, have not been precisely defined, or the interpretation of specific regulations is not unambiguous. Some regulations may also be controversial, because their literal interpretation leads to conclusions, that they are inconsistent and illogical. This results in numerous complications during the completion of tasks related to property division, as many matters depend on the individual interpretation of the surveyor contractor. An internship at the Provinsional Inspectorate of Geodetic and Cartografic Supervision, carried out in cooperation with the Faculty of Mining Geodesy and Environmental Engineering of the AGH University of Krakow, contributed to the development of the master's thesis on the issues referred to. An important element of the thesis, was the analysis of surveying reports, which were verificated by the Inspectorate. However, due to the limited transparency of the obtained materials, this article does not present the details of this part of the research thesis but only the conclusions drawn. The article refers both to problematic formal issues, practical remarks related to the boundary acceptance, as well as to proposals for clarification of currently applicable legal regulations.

W artykule dokonano wykładni przepisu art. 92 ust. 1 ustawy o gospodarce nieruchomościami, w którym ustawodawca określając przedmiotowy zakres regulacji określających zasady dokonywania podziałów nieruchomości zastosował technikę legislacyjną a contrario (wielokrotną negację), czyniąc ten tekst wyjątkowo nieczytelnym i językowo niezrozumiałym. Wnioski wynikające z przeprowadzonej analizy, z wykorzystaniem dyrektyw wykładni językowej i systemowej, pozwoliły na ustalenie rozumienia zakodowanej w nim normy prawnej i usunięcia wątpliwości dotyczących możliwości zastosowania ich w praktyce, tak aby były one spójne i zrozumiałe. Wykazano m.in., iż z „koniecznością wydzielenia nowych dróg”, o której mowa w art. 92 ust.1 tej ustawy mamy do czynienia wówczas, gdy w trakcie podziału nieruchomości nierolnej lub nieleśnej zachodzi potrzeba wydzielenia z terenów rolnych lub leśnych nowych dróg wewnętrznych, które zapewnić mają tym działkom dostęp do drogi publicznej.

The article interprets the provision of Art. 92 sec. 1 of the Real Estate Management Act, in which the legislator, while specifying the subject scope of the regulations specifying the rules for dividing real estate, applied the a contrario legislative technique (multiple negation), making this text exceptionally illegible and linguistically incomprehensible. Conclusions resulting from the analysis carried out, with the use of linguistic and systemic interpretations directives, made it possible to establish the understanding of the legal norm encoded in it and to remove doubts regarding the possibility of applying them in practice, so that they were consistent and understandable. It has been shown, among others, that with the "need to separate new roads", referred to in Art. 92 (1) of this Act, we are dealing with the situation when, during the division of non-agricultural or non-forest real estate, there is a need to separate new internal roads from agricultural or forest areas, which are to provide these plots with access to a public road.

W rezultacie przeprowadzonej wykładni językowej, z uwzględnieniem wniosków wynikających z systemowego i funkcjonalnego rozumienia tej regulacji, sformułowano tezę, iż pojęcie „dostępu do drogi publicznej” na potrzeby jej stosowania powinno być interpretowane w ujęciu funkcjonalnym, a nie formalnym i określonym przedmiotowo zakresie odniesionym jedynie do wydzielanych w wyniku podziału nieruchomości działek gruntu.

The publication interprets the provision of Art. 93 sec. 3 of the Real Estate Management Act, which determines the possibility of dividing real estate from providing access to a public road for the separated plots of land. As a result of the linguistic interpretation, taking into account the conclusions resulting from the systemic and functional understanding of this regulation, the thesis was formulated that the concept of "access to a public road" for the purposes of its application should be interpreted in a functional, not formal and subject-related scope, related only to the resulting division of real estate plots of land.

Korzystając ze zbioru danych opisujących rzeczywistość, istotną kwestią jest wiedza o jakości danych w nim zgromadzonych. W przypadku ewidencji gruntów i budynków, która stanowi podstawę m.in. planowania przestrzennego, określania wymiaru podatków i świadczeń, oznaczenia nieruchomości w księgach wieczystych, statystyki publicznej czy gospodarki nieruchomościami, określenie jakości danych w niej zawartych będzie miało kluczowe znaczenie. W kontekście rozważań wiarygodności i dokładności danych gromadzonych w bazie danych ewidencyjnych należy odnieść się przede wszystkim do dwóch atrybutów punktu granicznego: źródła danych o położeniu punktu granicznego (ZRD) oraz błędu średniego położenia punktu granicznego względem osnowy geodezyjnej 1 klasy (BPP). Artykuł przedstawia często wykonywane prace geodezyjne związane z określaniem przebiegu granic działek ewidencyjnych i wskazuje, jakie atrybuty ZRD mogą zostać nadane punktom granicznym określonym w toku tych czynności. Dla każdego z postępowań wskazano wartość atrybutu ZRD zależną m.in. od wyniku przeprowadzonego postępowania czy też od wykorzystanej metody pomiaru.

Using the data set describing reality, important issue is the knowledge of data quality collected in this set. In case of land and building register, which forms the basis of among others spatial planning, determining the size of taxes and benefits, designation of real estate in land and mortgage register, public statistics or real estate management, determining the quality of included data will be crucial. In terms of credibility and accuracy of data collected in the cadastral database, reference should be made primarily to two boundary point attributes: data sources on the boundary point location (ZRD) and the boundary point average position error in relation to the geodetic control network (BPP). This article presents frequently performed geodetic works related to determining the course of cadastral parcels borders and indicates which ZRD attributes can be given to the border points specified in the course of these activities. For each of the proceedings, the ZRD attribute value was indicated depending on, among others the result of the procedure carried out or the measurement method used.
