Artykuł dotyczy relacji pomiędzy zasadą jawności działania władz publicznych a koniecznością ochrony informacji istotnych z punktu widzenia bezpieczeństwa państwa. Autorzy wskazują, że prawo do informacji publicznej stanowi jedno z podstawowych praw obywatelskich w demokratycznym państwie prawnym, jednak nie ma charakteru absolutnego i może podlegać ograniczeniom wynikającym z potrzeby ochrony informacji niejawnych. W opracowaniu omówiono podstawy prawne ograniczania dostępu do informacji publicznej. Autorzy analizują także orzecznictwo sądów administracyjnych, które wskazuje, że odmowa udostępnienia informacji nie może opierać się wyłącznie na formalnym nadaniu klauzuli tajności. Organ administracji powinien wykazać, że dana informacja rzeczywiście spełnia ustawowe przesłanki uznania jej za niejawną oraz że jej ujawnienie mogłoby spowodować szkodę dla chronionych interesów państwa. Sądy podkreślają także konieczność zachowania zasady proporcjonalności i zakaz nadużywania instytucji tajemnicy w celu ograniczania kontroli społecznej nad działalnością administracji. Analizowana materia dotyczy relacji między jawnością a tajnością, która wymaga stałego wyważania konkurujących wartości konstytucyjnych. Jawność życia publicznego powinna pozostawać zasadą, natomiast ograniczenia związane z ochroną informacji niejawnych muszą mieć charakter wyjątkowy, uzasadniony i poddany kontroli sądowej.

This article examines the relationship between the principle of transparency in the activities of public authorities and the need to protect information relevant to state security. The authors point out that the right to public information is a fundamental civil right in a democratic state ruled by law, but it is not absolute and may be subject to limitations resulting from the need to protect classified information. The paper discusses the legal basis for restricting access to public information. The authors also analyze administrative court case law, which indicates that refusing to disclose information cannot be based solely on the formal designation of a confidentiality classification. The administrative body must demonstrate that the information in question actually meets the statutory criteria for classification as confidential and that its disclosure could harm protected state interests. The courts also emphasize the need to maintain the principle of proportionality and prohibit the abuse of confidentiality to limit public scrutiny of administrative activities. The issue under review concerns the relationship between openness and confidentiality, which requires a constant balancing of competing constitutional values. The transparency of public life should remain the principle, while restrictions related to the protection of classified information must be exceptional, justified and subject to judicial review.

Prowadzenie działalności gospodarczej zawsze wiąże się z ryzykiem finansowym - zależnie od okoliczności można się znaleźć zarówno w sytuacji wierzyciela, jak i dłużnika. Warto zatem przyjrzeć się procedurze postępowania egzekucyjnego mającego na celu przymusową realizację należnego świadczenia. Sprawdzić, jak można wszcząć taką procedurę, ewentualnie, jak się zabezpieczyć, gdy w stosunku do nas zostanie ona wszczęta.

Należycie sporządzona umowa jest dla każdego przedsiębiorcy kluczowym zabezpieczeniem. Aby odzwierciedlała rzeczywistą wolę stron i zarazem była kompletna pod względem formalnym, nie wystarczy znajomość tylko ogólnych postanowień umownych.

The Directive 2009/31 / EC entered into force on the 23 April 2009 and EU member countries had to implement its regulations into their legal system. The Directive regulates the activity of geological storage of CO2. The Derective 2009/31/EC permits the EU member countries to forbid the underground geological storage of carbon dioxide on the whole or part of its territory. In Poland, the preparation for the legislative works on the geological storage of carbon dioxide started already in 2007, i.e. at the moment, when politicians began to speak in the European Union about the need to prepare such a directive. Initially, Poland wanted to prohibit underground geological storage of carbon dioxide (the ban does not apply to the EGR or EOR i.e. injection of CO2 into hydrocarbon reserves for more efficient production). The change of government in 2007 had an impact on the situation in the country. The government (PO-PSL) presented in June 2013 a bill about experimental and demonstration installations of CCS for the capture and storage of carbon dioxide. During the legislative works on implementation of the regulations of Directive 2009/31/EC, the deputy of Polish Parliament (Sejm RP) presented two amendments to the government bill, which had to ban geological storage of carbon dioxide in Poland. According to the first amendments the CCS activity can be used only if the space in which carbon dioxide will be stored, has no other economic, agricultural or natural value. The second amendment gives SejmikWojewódzki the power to decide on the location of carbon dioxide underground storage on its territory. Both amendments were rejected by the PO-PSL coalition, and the Parliament voted for the new law without the regulation contained in art. 4, paragraph 1 of Directive 2009/31/EC. Germany used art. 4, paragraph 1 of Directive 2009/31 / EC (in contrast to Poland). The German Act authorized the federal states to decide whether underground storage of carbon dioxide would be permitted on their territory or not. The first German federal states, which banned underground geological storage of carbon dioxide were Mecklenburg-Vorpommern and Schleswig-Holstein. On the territory of Lower Saxony, there is currently a moratorium on underground geological storage of carbon dioxide. The government of Lower Saxony is working on a new law, which will propably ban the CCS activity on its territory in the future.

Artykuł przedstawia formalizację czynności tworzenia modelu typów na etapie specyfikowania z zastosowaniem języka klauzul. Zastosowanie języka logiki jest bliższe ludzkiemu myśleniu niż inne formalizmy. Umożliwia to przeniesienie mechanizmu wnioskowania dokonywanego przez analityka systemowego w procesie projektowania systemu, do zapisu czytelnego dla systemów komputerowych. Opisana reprezentacja zostanie użyta podczas opracowywania systemu wspomagającego analityka w podejmowaniu decyzji na poszczególnych etapach projektu.

This paper presents a formal representation of develop type model activity at specification stage in a clausal language. Logic language is more human-oriented than other formalism. Using clauses enables to represent a mechanism of concluding used in a process of designing the system. This representation will be used in a decision support system which will support a designer.
