W niniejszym artykule przedstawione zostało zagadnienie prawne dotyczące instytucji odmowy wszczęcia postępowania administracyjnego w sprawach z zakresu aktualizacji informacji zawartych w ewidencji gruntów i budynków. W nawiązaniu do przepisów procesowego i materialnego prawa administracyjnego regulujących tą problematykę oraz poglądów doktryny i judykatury, wskazane zostały przesłanki podmiotowe i przedmiotowe obligujące organ rejestrowy do odmowy wszczęcia postępowania jurysdykcyjnego w ustalonej prawem formie.

This article examines the legal framework governing the refusal to initiate administrative proceedings related to the updating of information contained in the land and building register. Drawing upon relevant provisions of procedural and substantive administrative law, as well as established positions in legal doctrine and jurisprudence, the study identifies the subjective and objective prerequisites that oblige the registration authority to issue a formal refusal to commence jurisdictional proceedings.
Państwowy Rejestr Granic to baza danych prowadzona przez Główny Urząd Geodezji i Kartografii, zawierająca dane o przebiegu granic i powierzchni jednostek podziałów terytorialnych kraju. W praktyce okazuje się, że dane gromadzone w tym rejestrze często nie pokrywają się z danymi ujawnionymi w ewidencji gruntów i budynków prowadzonej na poziomie powiatów. Brak spójności dotyczy zwłaszcza granic między sąsiednimi powiatami, choć również i na poziomie jednostek ewidencyjnych oraz obrębów występują rozbieżności, co w konsekwencji przekłada się na ich powierzchnię. W artykule rozpatrywane są główne przyczyny takiego stanu rzeczy. Autorzy przedstawiają także możliwe procedury ujednolicenia danych oraz wskazują problemy związane z ich potencjalnym wdrożeniem.

The State Register of Borders is a database maintained by the Head Office of Geodesy and Cartography, containing data on the boundaries and areas of the administrative units of Poland. In practice, the data stored in this register often does not coincide with the data recorded in the land and building register maintained at the county level. The lack of consistency is particularly evident between the borders between neighbouring counties, although discrepancies also occur at the level of cadastral units and precincts, which consequently affect their calculated areas. The article discusses the main causes of these inconsistencies. The authors also present possible procedures for data harmonisation and indicate the challenges associated with their potential implementation.
The real estate cadastre is currently available as the core of the land management system. Cadastral maps resulting from the presentation of complete and comprehensive information about the purpose of presenting the rights and rights of their owners and rulers. The scope of this research, both in Poland and abroad, shows that the legal projection carried out on two-dimensional maps cannot be integrated, overlapping properties, therefore it is extended to three-dimensional space. The purpose of the publication is to provide technical and legal analyzes that may cover the introduction of layered products in Poland. The main research includes: understanding the concept of layering, including defining what is a consequence of layering and diagnosing the scope of changes within legal provisions; research on legal provisions and regulations regarding recommendations regarding changes in legal provisions and technical procedures. Scientific research methods concern a holistic product, legal and technical aspects, a review of the subject literature, legal regulations and a case study. Using a manuscript available on the technical and legal platform, in the context of the possibility of implementing a multidimensional cadastre in the Polish legal system. The author’s note also concerns the conceptual model of spatial subject data, the registration unit, the extension of the warranty for specific plots, and the setting of milestones for the integration of Ladm, Ifc and CityGml solutions. A new term has been introduced for multi-dimensional, multi-task, relational and synergistic systems, included in integration units with other standards: Smart Cadastre.

Kataster nieruchomości uznaje się obecnie za rdzeń systemu zarządzania gruntami. Mapy katastralne powinny zatem przedstawiać pełne i wyczerpujące informacje przestrzenne celem zaprezentowania zasięgu praw i ograniczeń przysługujących ich właścicielom i władającym. Z przeprowadzonych w tym zakresie badań, zarówno w Polsce jak i za granicą, wynika, że zrealizowana projekcja praw na mapach dwuwymiarowych nie może uwzględniać złożonych, nakładających się na siebie nieruchomości, dlatego powinna zostać rozszerzona na przestrzeń trójwymiarową. Celem niniejszej publikacji jest przeprowadzenie analizy technicznych i prawnych aspektów związanych z potencjalnym wprowadzeniem własności warstwowej w Polsce. Główne cele badań obejmują: zrozumienie koncepcji własności warstwowej w tym zdefiniowania czym jest własność warstwowa oraz zdiagnozowania zakresu zmian w ramach istniejących przepisów prawnych; badania istniejących przepisów prawnych oraz określenie potencjalnych rekomendacji dotyczących ewentualnych zmian w prawie oraz procedurach technicznych. Metodyka badań opiera się na podejściu holistycznym łączącym aspekty prawne i techniczne zakładające przegląd literatury przedmiotu, analizę przepisów prawnych oraz studium przypadku. Za osiągnięcie manuskryptu należy uznać przeprowadzoną analizę technicznych i prawnych w kontekście możliwości implementacji katastru wielowymiarowego w polskim systemie prawnym. Na uwagę zasługują także autorska propozycja modelu pojęciowego przestrzennych danych przedmiotowych, wprowadzenie przestrzennej jednostki rejestrowej, rozszerzenie rękojmi obejmującej powierzchnię działek o ustalonych granicach, a także wyznaczenie kroków milowych integracji standardów Ladm, Ifc oraz CityGml. Informacje na temat struktury użytkowania gruntów pełnią istotną rolę dla wielu dziedzin gospodarki. Zarówno ich zakres jak i sposób gromadzenia oraz wykorzystywania ulegały wielokrotnym zmianom na przestrzeni lat. Z tego powodu analiza materiałów dotyczących użytków gruntowych wymaga odwoływania się do różnych źródeł oraz aktów prawnych obowiązujących w poszczególnych okresach. Dlatego też autorzy niniejszego opracowania, pochylili się nad przywołaną problematyką, aby usystematyzować najistotniejsze zmiany, wraz z ich omówieniem oraz przywołaniem stosownych podstaw prawnych z których wynikały. Jednocześnie artykuł stanowi wprowadzenie do szerszego opracowania dotyczącego problematycznych kwestii związanych z użytkami gruntowymi, w szczególności aktualnymi zasadami zaliczania gruntów do poszczególnych rodzajów użytków.

Information regarding land use structure plays a significant role in many areas of the economy. Both their scope, method of collection and utilization have undergone multiple changes over the years. Therefore, the analysis of materials concerning land uses requires reference to various sources and legal acts applicable in specific periods. Hence, the authors of this work have delved into the mentioned issues to systematize the most significant changes, along with their discussion and citation of the relevant legal bases they stem from. Simultaneously, the article serves as an introduction to a broader study concerning problematic issues related to land uses, particularly the current rules for classifying lands into different types of use.
Sposób zaliczania gruntów do poszczególnych rodzajów użytków wynika bezpośrednio z przepisów rozporządzenia w sprawie ewidencji gruntów i budynków. Niestety zawarte w nim kryteria często cechują się niejednoznacznością interpretacji. Widać to na przykładzie gruntów rolnych zabudowanych, na których zasięg mają wpływ różne czynniki. W niniejszym artykule przeanalizowano je oraz wskazano najistotniejsze aspekty, na które musi zwrócić uwagę geodeta podczas zaliczania gruntów do tego rodzaju użytku. Ponadto podjęto się interpretacji kryteriów zawartych w załączniku do przywołanego rozporządzenia. Koniecznym okazało się także odwoływanie do innych, powiązanych aktów prawnych. Dodatkowo pochylono się nad konsekwencjami wynikającymi z zaliczenia gruntu do tego rodzaju użytku – mowa tutaj o formie oraz wymiarze opodatkowania takiego gruntu. Końcowo wyciągnięto wnioski z przeprowadzonych analiz oraz wskazano propozycję uproszczenia aktualnych kryteriów, a także zakwestionowano korzyści wynikające z wyróżniania tego rodzaju użytku.

The method of classifying land into different types of use directly stems from the provisions of the regulation concerning the registry of land and buildings. Unfortunately, the criteria contained within it often exhibit ambiguity in interpretation. This is evident in the case of built-up agricultural land, where various factors influence its classification. In this article, these factors are analyzed, and the most significant aspects that a surveyor must consider when classifying land for this type of use are identified. Additionally, an interpretation of the criteria outlined in the annex to the referenced regulation is undertaken. It was also necessary to refer to other related legal acts. Furthermore, attention is paid to the consequences of classifying land for this type of use – specifically regarding the form and extent of taxation of such land. Finally, conclusions are drawn from the conducted analyses, a proposal for simplifying the current criteria is provided, and the benefits of distinguishing this type of use are questioned.
Kryteria zawierające zasady zaliczania gruntów do użytku terenów mieszkaniowych, zawarte w przepisach dotyczących ewidencji gruntów i budynków, precyzują jakie grunty powinny być zaliczone do tego użytku. Jednakże problematyka jest bardziej skomplikowana. Wynika to częściowo ze złożoności procesu inwestycyjnego, którego skutkiem w większości przypadków jest zmiana sposobu użytkowania gruntu, objętego zamierzeniem budowlanym podczas geodezyjnej inwentaryzacji powykonawczej. Z tego powodu w niniejszym artykule, obok analizy samych kryteriów zawartych w rozporządzeniu w sprawie ewidencji gruntów i budynków, pochylono się również nad najważniejszymi aspektami dotyczącymi geodezyjnej inwentaryzacji powykonawczej. Finalnie wskazano optymalny sposób interpretacji poszczególnych zapisów. W tym celu posiłkowano się istotnym wyrokiem sądowym oraz odwołano się do interpretacji Ministra Rolnictwa i Rozwoju Wsi z 2021 r.

The criteria establishing the principles for classifying land as residential areas, contained within the regulations concerning the registry of land and buildings, specify which lands should be included in this category. However, the issue is more complex. This complexity, partly stem from the intricacies of the investment process, which, in most cases, results in change in land use as a consequence of post-construction geodetic surveys. Therefore, in this article, apart from analysing the criteria for land classification, contained in the regulation on land and building registration, attention is also paid to the most important aspects, concerning the as-built geodetic inventory. Finally, the optimal ways to interpret the various regulations were proposed. For this purpose, an important court judgment and the Minister’s of Agriculture and Rural Development interpretation from 2021 were cited.
Celem pracy jest określenie stopnia, w jakim możliwe jest wykorzystanie danych otrzymanych z bezzałogowych statków powietrznych (BSP) w pracach związanych z aktualizacją i modernizacją geodezyjnych baz danych. W pracy zbadano jak wybór oprogramowania wpływa na materiały źródłowe otrzymane z wykorzystaniem BSP. W opracowaniu wykorzystano trzy niezależne oprogramowania pozwalające na przetworzenie danych z BSP. Opracowanie opiera się na wykorzystaniu ukośnych zdjęć dla obszaru południowej Polski i ich opracowaniu za pomocą oprogramowania fotogrametrycznego trzech najpopularniejszych producentów: Agisoft, Bentley, Pix4D. W metodyce zaproponowano porównanie danych wynikowych: chmur punktów, siatek mesh, ortomozaiki. Porównanie ma na celu weryfikacje wiarygodności uzyskanych wyników poprzez porównanie z klasycznym geodezyjnym pomiarem uzyskanym w wyniku pomiaru na osnowę za pomocą tachimetru elektronicznego ze wsparciem odbiornika GNSS. W analizie główny nacisk położono na porównanie obmiarów budynków ze zdjęć ukośnych oraz z pomiaru terenowego. W etapie post-processingu otrzymano metryczne modele budynków 3D i dokonano ich wizualizacji, celem weryfikacji.

The aim of the work is to determine the extent to which it is possible to use data obtained from unmanned aerial vehicles (UAVs) in works related to updating and modernization of geodetic databases. The work examined how the choice of software affects the source materials obtained using UAV. The study used three independent software to process data from UAVs. The study is based on the use of oblique photos for the area of southern Poland and their processing using photogrammetric software from the three most popular manufacturers: Agisoft, Bentley, Pix4D. The methodology proposes a comparison of the resulting data: point clouds, meshes, orthomosaics. The methodology proposes a comparison of the resulting data: point clouds, meshes, orthomosaics. The purpose of the comparison is to verify the reliability of the results obtained by comparing them with a classic geodetic measurement obtained as a result of a matrix measurement using an electronic total station with the support of a GNSS receiver. The main emphasis in the analysis was on comparing building dimensions from oblique photos and field measurements. In the post-processing stage, metric 3D building models were obtained and visualized for verification.
The real estate cadastre, understood as a public register and a legal institution, has since ancient times guaranteed legal certainty in property transactions and the implementation of fiscal objectives related to the collection of taxes. Over time, new tasks have been assigned to the cadastre. Reports published by international organizations such as the International Federation of Surveyors (FIG) and the United Nations (UN) have revealed the shortcomings of existing legal systems in the management of land administration rights, restrictions and obligations. In this context, to the paper presents a polemic on the possibility of implementing a multidimensional cadastre in Poland and Slovakia. The most important milestones in the evolution of the land administration system in both countries were reviewed and the possibility of implementing layer ownership was discussed. The aim of this publication is to conduct a comparative study with a view on research on the applicable legal regulations in the context of the possibility and legitimacy of the implementation of the multidimensional cadastre in both countries. The research method used is a case study. It was supported by an analysis of legislation in the above-mentioned scope and a field interview. The research carried out as part of the comparative study clearly indicates the legitimacy of introducing the registration of layer ownership. The type of legal systems in Poland and Slovakia will have a significant impact on the degree of complexity of the multidimensional cadastre implementation process.
W artykule podjęto się próby ustalenia, czy obowiązujące przepisy określające zasady prowadzenia ewidencji gruntów i budynków mają charakter zasad lub domniemań prawnych, czy też jedynie typowych reguł prawa nakazujących organowi ewidencyjnemu (staroście) ściśle określone postępowanie rejestrowe, ale nieformujących ani obowiązku znajomości wpisu, ani domniemania prawnego znajomości wpisu czy też innych zasad i domniemań związanych z wiarygodnością danych ewidencyjnych ujawnionych w tym rejestrze. Wskazane zostały te normy prawa materialnego i procesowego, na podstawie których można odpowiednio sformułować zasadę prawdziwości wpisu i jego aktualności w rozumieniu ich zgodności z dokumentami źródłowymi stanowiącymi podstawę ich ujawnienia oraz wiarygodności ewidencji gruntów i budynków jako urzędowego rejestru publicznego.

The article attempts to determine whether the applicable provisions specifying the rules for keeping records of land and buildings have characteristics of legal principles or presumptions, or only typical legal rules requiring the registration authority (governor) to have strictly defined registration proceedings, but not requiring the knowledge of the record or having any legal presumption or knowledge related to the credibility of registration data disclosed in this register. The norms of substantive and procedural law have been indicated, on the basis of which the principle of truthfulness of the entry and its timeliness can be formulated in the sense of their compliance with the source documents constituting the basis for their disclosure and the credibility of the land and building records as an official public register.
W artykule zaprezentowana została i poddana analizie definicja legalna pojęcia „terenów mieszkaniowych” wykazywanych w ewidencji gruntów i budynków. Poczynione ustalenia pozwoliły na sformułowanie tezy, iż przebieg konturu użytku gruntowego terenów mieszkaniowych ujawniany w operacie ewidencyjnym jest pochodną przeznaczenia budynków na wskazane cele, z wyłączeniem budynków wchodzących w skład terenów rolnych zabudowanych. Przebieg konturu użytku gruntowego nie jest ograniczony granicami działek ewidencyjnych, na których usytuowane są budynki mieszkalne i gospodarcze, lecz jest wyznaczony granicami działki budowlanej obejmującej także tereny bezpośrednio do nich przyległe, niezbędne do racjonalnego z nich korzystania. W przypadku ujawniania w ewidencji nowo wybudowanych budynków przebieg konturu użytku „B” powinien być zgodny z granicami działki budowlanej wykazanej na rysunku projektu planu zagospodarowania działki lub terenu za pomocą linii, o których mowa w lp. 2.7 Polskiej Normy PN-B-01027:2002.

The article presents and analyzes the legal definition of the concept of "residential areas" included in the land and building register. The findings from the article made it possible to formulate a thesis that the course of the contour of land used for residential areas that is disclosed in the inventory register is a derivative of the functional use of buildings for the indicated purposes, with the exception of buildings included in built-up agricultural areas. The course of the contour of land use is not limited by the boundaries of the registration plots on which residential and farm buildings are located, but is determined by the boundaries of the construction plot, also including the areas directly adjacent to them, necessary for their rational usage. In the case of disclosure in the records of newly constructed buildings, the course of the contour of use "B" should be consistent with the boundaries of the building plot indicated in the drawing of the plot or area development project plan by using the lines referred to in item no. 2.7 of the Polish Standard PN-B-01027: 2002.
Celem artykułu było przedstawienie możliwości zastosowania bezzałogowych statków powietrznych w pracach scaleniowych na podstawie analizy wysokorozdzielczej ortomozaiki cyfrowej powstałej ze zdjęć lotniczych w aspekcie wywiadu terenowego oraz pomiaru elementów niezmiennikowych projektu scalenia gruntów. Zakres przestrzenny badań stanowiły zdjęcia wykonane podczas nalotu na obszarze obrębu ewidencyjnego Marcinkowice, położonego gminie Charsznica, w powiecie miechowskim, w województwie małopolskim. W miejscowości prowadzone są prace scaleniowe, których wykonawcą jest Krakowskie Biuro Geodezji i Terenów Rolnych w Krakowie. Wykorzystano dane pozyskane w ramach nalotów BSP pozyskane na obrębie ewidencyjnym Marcinkowice oraz geodezyjne bazy danych: BDOT500, GESUT i EGiB. W niniejszym artykule podjęto próbę weryfikacji danych pozyskanych z wykorzystaniem ortomozaiki w weryfikacji błędów, nieścisłości i kolizji budynków z granicami działek ewidencyjnych, identyfikacji rozbieżności dotyczących użytkowania gruntów, czy różnic w przebiegu dróg pomiędzy mapą zasadniczą, a stanem faktycznym na gruncie.

The main aim of the work is present the possibility of using unmanned aerial vehicles in consolidation works based on the analysis of high-resolution digital orthomosaic created from aerial photos in the aspect of field intelligence and measurement of invariant elements of the land consolidation project. The spatial scope of the research was constituted by photos taken during the raid in the area of the Marcinkowice registration area, located in the Charsznica commune, in the Miechów district, in the Małopolskie voivodship. Consolidation works are being carried out in the village, the contractor of which is the Krakow Office of Geodesy and Rural Areas in Krakow. Data obtained as part of UAV raids obtained in the Marcinkowice registration area and geodetic databases: BDOT500, GESUT and EGiB were used. This article attempts to verify the data obtained with the use of orthomosaic in the verification of errors, inaccuracies and collisions of buildings with the boundaries of registration plots, identifying discrepancies in land use, or differences in the route of roads between the main map and the actual state on the ground.
W artykule dokonano wykładni przepisu § 31 rozporządzenia sprawie ewidencji gruntów i budynków przy zastosowaniu dyrektyw wykładni językowej, systemowej i funkcjonalnej celem ustalenia rozumienia zakodowanej w nim normy prawnej i usunięcia wątpliwości dotyczących możliwości zastosowania w praktyce geodezyjnej procedury ustalania przebiegu granic działek ewidencyjnych. Wykazano, iż komentowany przepis pozostaje w wyraźnej sprzeczności z treścią innych norm prawa regulujących problematykę ustalania granic nieruchomości (zapisanych w rozdziale 6 Prawa geodezyjnego i kartograficznego), a jego stosowanie w praktyce prowadzić może do nieuprawnionych rozstrzygnięć, tj. korygowania przebiegu granic prawnych ustalonych w trybie administracyjnym lub sądowym. We wnioskach końcowych sformułowano postulat, aby do czasu jego zmiany był on stosowany w praktyce z uwzględnieniem wykładni systemowej, tj. przepisów rozdziału 6 p.g.k.

The article interprets the provision of § 31 of the regulation on land and building records with the use of linguistic, systemic and functional interpretations directives in order to establish the understanding of the legal norm encoded therein and remove doubts regarding the applicability in geodetic practice of the procedure for determining the boundaries of registration plots. It has been shown that the commented provision clearly contradicts the content of other legal norms regulating the issues of determining the boundaries of real estate (provided for in chapter 6 of the Geodetic and Cartographic Law), and its application in practice may lead to unauthorized decisions, i.e. correcting the course of established legal boundaries under the administrative or judicial procedure. In the final conclusions, a postulate was formulated that until it is changed, it should be applied in practice, taking into account the systemic interpretation, i.e. the provisions of chapter 6 of the Geodetic and Cartographic Law.
From the legal point of view, the soil science classification is regulated by the Geodetic and Cartographic Law, where it is defined as the division of soils into valuation classes due to their production quality determined on the basis of the genetic characteristics of the soil. The executive act regulating the issue of soil science classification of land are the provisions included in the Regulation of the Council of Ministers of September 12, 2012 on soil science classification of land (Journal of Laws 2012, item 1246). The aim of the article was to present the problems resulting from the lack of regulation of the profession of land classifier and the lack of uniform administrative procedures regarding the selection of the classifier for the purposes of the classifications. The research method used is the case study. The method was supported by the analysis of legislation in the above-mentioned scope.

Gleboznawcza klasyfikacja gruntów z punktu widzenia prawnego regulowana jest poprzez ustawę Prawo Geodezyjne i Kartograficzne, gdzie zdefiniowana jest jako podział gleb na klasy bonitacyjne ze względu na ich jakość produkcyjną ustaloną na podstawie cech genetycznych gleb. Aktem wykonawczym regulującym zagadnienie gleboznawczej klasyfikacji gruntów są przepisy zawarte w Rozporządzeniu Rady Ministrów z dnia 12 września 2012 r. w sprawie gleboznawczej klasyfikacji gruntów (Dz.U. 2012 poz.1246). Celem artykułu było przedstawienie problemów wynikających z braku uregulowania zawodu klasyfikatora gruntów oraz braku jednolitych procedur administracyjnych dotyczących wyboru klasyfikatora na potrzeby realizowanych prac klasyfikacyjnych. Stosowaną metodą badawczą jest studium przypadku. Metoda została wsparta analizą prawodawstwa w wyżej wymienionym zakresie.
W artykule zaprezentowane zostało zagadnienie prawne dotyczące ustalenia znaczenia normatywnego pojęcia „las” zapisanego w art. 3 ustawy o lasach. W nawiązaniu do poglądów judykatury i orzecznictwa przedstawiono istniejące w obiegu prawnym rozbieżności w interpretacji tego pojęcia oraz skutki z tego wynikające. Na tym tle przedstawiona została wykładnia logiczna i językowa tego terminu oraz pojęć definiujących to określenie, w nawiązaniu do całego aktu normatywnego. Poczynione uwagi pozwoliły na sformułowanie tezy, iż dla ustalenia, że grunt jest lasem nie tylko w znaczeniu przyrodniczym, ale także prawnym (art. 3 u.o.l.), konieczne jest spełnienie łącznie nie tylko kryterium przyrodniczego (pokrycia roślinnością leśną) i kryterium przestrzennego (zwarta powierzchnia co najmniej 0,10 ha), lecz także jednej z przesłanek wymienionych alternatywnie w art. 3 pkt 1 lit. „a,b,c” u.o.l, w tym w szczególności przeznaczenia tych gruntów do produkcji leśnej.

The article presents a legal issue regarding the determination of the normative meaning of the term „forest” represented in article 3 of the Forests Act. Referring to the views of jurisprudence and jurisdiction, differences in the interpretation of this concept existing in the legal circulation are presented, as well as the consequences resulting therefrom. Against this background, the logical and linguistic interpretation of this term and the concepts defining this term in relation to the entire normative act have been presented. The comments made allowed the formulation of the thesis that in order to establish that land is a forest not only in natural meaning, but also in legal terms (art. 3 of the Forest Act), it is necessary to meet not only the criterion of nature (coverage with forest flora) and the spatial criterion (compact surface of at least 0.10 ha), but also one of the conditions listed alternatively in art. 3 point 1 a-c of the Forest Act, including in particular the purpose of these lands for forest production.
W artykule podjęta została próba doprecyzowania pojęcia „działki drogowej” na potrzeby jej oznaczania w katastrze nieruchomości. Wykładni zostały poddane podstawowe definicje ustalające znaczenie pojęciowe: pasa drogowego, drogi, drogi publicznej i wewnętrznej, drogi transportu rolnego i drogi rowerowej, do których odsyłają przepisy określające zasady zaliczania gruntów do poszczególnych użytków gruntowych. The article attempts to clarify the concept of a „road plot” for the purposes of marking it in the real estate cadastre. The basic definitions were given determining the conceptual meaning of: road lane, road, public and internal road, agricultural transport road and bicycle road, which are referred to in the provisions that define the principles of registering land to specific land uses. At the end, conclusions were formulated to specify these concepts, which may be helpful in identifying such objects and registering them in the land and building register.
W artykule zaprezentowane zostały i poddane analizie definicje legalne pojęcia działki budowlanej oraz zasady ich oznaczania w ewidencji gruntów i budynków. Poczynione ustalenia pozwoliły na sformułowanie tezy, iż przy ustalaniu przebiegu konturu użytku gruntowego terenów zabudowanych i zurbanizowanych należy uwzględniać nie tylko obszar gruntu wyłączony z produkcji rolnej i leśnej decyzją, o której mowa w art. 11 ust. 1 ustawy o ochronie gruntów rolnych i leśnych, ale także teren niezbędny do prawidłowego i racjonalnego korzystania z budynków i urządzeń położonych w granicach działki budowlanej. Granice tak definiowanej działki budowlanej, określone w planie zagospodarowania działki lub terenu (art. 34 ust. 3 Prawa budowlanego) wyznaczają bowiem zasięg gruntów, w odniesieniu do których ustalony został ich sposób użytkowania wynikający z istniejącej lub projektowanej zabudowy.

The article presents and analyzes legal definitions of the concept of a construction plot and the rules for its designation in the land and building register. The findings made allowed the formulation of the thesis that during the determination of the contour of the land, which is located in built-up and urbanized areas, sides involved should consider not only the land area that is excluded from agricultural and forestry production (by the decision referred to in art. 11 paragraph 1 of the Act on the Protection of Agricultural and Forest Land), but also take into account the area necessary for the proper and rational use of buildings and infrastructure located within the boundaries of a construction plot. The boundaries of a construction plot defined in the plot or land development plan (Article 34 (3) of the Building Law) are in fact determining the extent of land for which the use regime has been established which is resulting from existing or planned buildings.
Jedną z najtańszych i najszybszych metod pozyskania informacji o położeniu punktów granicznych jest wykorzystanie geodezyjnych pomiarów kartometrycznych. Metoda ta bazuje przede wszystkim na istniejących mapach ewidencyjnych i katastralnych, które zostały uprzednio zeskanowane i wpasowane. Niniejszy artykuł przedstawia podstawowe zasady dotyczące skanowania map analogowych oraz transformacji rastrów tych map w kontekście obowiązujących przepisów prawa, jak również istniejących badań i publikacji. Podstawowym celem artykułu jest oszacowanie wartości błędu położenia punktów granicznych (atrybut BPP), których położenie wyznaczono na podstawie geodezyjnych pomiarów kartometrycznych, z uwzględnieniem m.in. błędu pomiaru punktu czy skali mapy.

One of the cheapest and fastest methods of obtaining information on the boundary points position is the use of geodetic cartometric measurements. This method is based on existing cadastral maps that have been previously scanned and calibrated. This article presents the basic principles of scanning analog maps, transformation of these maps in the context of applicable law, as well as existing research and publications. The main purpose of the article is to estimate the boundary point position mean error (BPP attribute), location of which was determined on the basis of geodetic cartometric measurements, including point measurement error or map scale.

Artykuł został podzielony na cztery części opisujące okresy regulowane różnymi przepisami prawnymi oraz wytycznymi technicznymi: okres zaborów, okres dwudziestolecia międzywojennego, okres od zakończenia drugiej wojny światowej do 1979 roku oraz okres od 1979 do 2011 roku. Dla każdego z okresów podjęto próbę określenia dokładności wyznaczenia położenia punktu granicznego w kontekście współczesnych wymagań katastru. This article presents historical legal regulations and measurement technologies that affect the accuracy of determining the boundary point location. The article was divided into four parts. Each part describes the period of time, when various legal regulations were in force: the partitions period, the interwar period, the period since the end of World War II to 1979 and the period since 1979 to 2011. For each period an attempt was made to determine the boundary point location accuracy determining in the context of modern cadastre requirements. Also the BPP attribute value is proposed that can be assigned to points depending on the date of the measurement as well as the measurement method used.

Korzystając ze zbioru danych opisujących rzeczywistość, istotną kwestią jest wiedza o jakości danych w nim zgromadzonych. W przypadku ewidencji gruntów i budynków, która stanowi podstawę m.in. planowania przestrzennego, określania wymiaru podatków i świadczeń, oznaczenia nieruchomości w księgach wieczystych, statystyki publicznej czy gospodarki nieruchomościami, określenie jakości danych w niej zawartych będzie miało kluczowe znaczenie. W kontekście rozważań wiarygodności i dokładności danych gromadzonych w bazie danych ewidencyjnych należy odnieść się przede wszystkim do dwóch atrybutów punktu granicznego: źródła danych o położeniu punktu granicznego (ZRD) oraz błędu średniego położenia punktu granicznego względem osnowy geodezyjnej 1 klasy (BPP). Artykuł przedstawia często wykonywane prace geodezyjne związane z określaniem przebiegu granic działek ewidencyjnych i wskazuje, jakie atrybuty ZRD mogą zostać nadane punktom granicznym określonym w toku tych czynności. Dla każdego z postępowań wskazano wartość atrybutu ZRD zależną m.in. od wyniku przeprowadzonego postępowania czy też od wykorzystanej metody pomiaru.

Using the data set describing reality, important issue is the knowledge of data quality collected in this set. In case of land and building register, which forms the basis of among others spatial planning, determining the size of taxes and benefits, designation of real estate in land and mortgage register, public statistics or real estate management, determining the quality of included data will be crucial. In terms of credibility and accuracy of data collected in the cadastral database, reference should be made primarily to two boundary point attributes: data sources on the boundary point location (ZRD) and the boundary point average position error in relation to the geodetic control network (BPP). This article presents frequently performed geodetic works related to determining the course of cadastral parcels borders and indicates which ZRD attributes can be given to the border points specified in the course of these activities. For each of the proceedings, the ZRD attribute value was indicated depending on, among others the result of the procedure carried out or the measurement method used.
